5. Neither the design of the subdivision nor any proposed improvements are likely to cause substantial
environmental damage or substantially and avoidably injure fish or wildlife or their habitat.
• This finding can be made because the design of the subdivision or the proposed
improvements are not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat. The Initial Study prepared for this
project did not identify any known rare or endangered species or habitats or other
substantial environmental adverse effects.
6. The design of the subdivision or type of improvement is not likely to cause significant public health
problems.
• This finding can be made because the subdivision will be served by public wastewater
treatment, public water, and public stormwater drainage through an on-site detention
basin to be dedicated to County Service Area No. 41.
7. The design of the subdivision or the types of improvements will not conflict with easements acquired
by the public at large for access through or use of property within the proposed subdivision.
• This finding can be made because the design of the subdivision and the type of
improvements will not conflict with easements, acquired by the public at large, for access
through or use of the property within the proposed subdivision. There is an existing
storm drain easement along the eastern property line of the project site to access Mormon
Slough. The stormwater detention basin will have direct access for a public utility and
storm drain easement from Elvera Court.
8. Any land or improvements to be dedicated to the County or other public agency is consistent with the
General Plan, any applicable Specific Plan and Special Purpose Plan, and any other applicable plan
adopted by the County.
• This finding can be made because the land to be dedicated to the San Joaquin County
Flood Control and Water Conservation District along Mormon Slough (Lot A) and the land
to be dedicated to the County for the detention basin (Lot B) are consistent with the
General Plan. There are no Specific Plans, Special Purpose Plans, nor other applicable
plans in the project vicinity.
9. The design of the subdivision provides, to the extent feasible, for future passive or natural heating or
cooling opportunities in the subdivision, as required by Government Code Section 66473.1
• This finding can be made because the design of the subdivision provides, to the extent
feasible, for future passive or natural heating or cooling opportunities in the subdivision,
as required by the Government Code since the lots are large enough so that individual
dwellings can be situated to take advantage of solar orientation.
San Joaquin County PA-0400524/Century 21 Properties Unlimited
Community Development Page 5
