Zone application if the affordability bonus is in conjunction with the bonus for planned <br /> development. <br /> A developer may submit a preliminary written proposal pursuant to this section prior to the <br /> submittal of any application for residential development. Within 90 days the County shall notify <br /> the developer in writing of any additional procedures necessary to comply with this section and <br /> Section 65915 of the Government Code. <br /> Guarantees For Continued Affordability <br /> The developer shall agree to ensure continued affordability of all lower income density bonus <br /> units for: <br /> a. thirty (30) years, or a longer period of time if required by the construction or mortgage <br /> financing assistance program, mortgage insurance program, or rental subsidy program, <br /> or <br /> b. ten (10) years if the county does not grant at least one of the additional incentives and <br /> government financing with a longer designated preservation period is not used for the <br /> project. <br /> The developer shall enter into an Agreement with San Joaquin County to ensure compliance with <br /> the provisions of this section. (Development Title Section 9-315.7) <br /> Riparian Habitat <br /> The Mormon Slough is adjacent to the southern boundary of the project site. Development Title <br /> Section 9-1510.5 states that parallel to any natural bank of a waterway, a natural open space for <br /> riparian habitat and waterway protection shall be maintained to provide nesting and foraging <br /> habitat and the protection of waterway quality. The minimum width of said open space shall be <br /> one-hundred (100) feet, measured from the mean high water level of the natural bank or fifty (50) <br /> feet back from the existing riparian habitat, whichever is greater. Water-dependent uses may be <br /> permitted in this buffer. This setback line needs to be shown on the tentative map if a full <br /> application is submitted. <br /> Wastewater Disposal <br /> Development Title Section 9-1105.3(a) states that subdivisions within an urban community shall <br /> be served by a public wastewater disposal system. Wastewater disposal is provided by the East <br /> Stockton Sanitary Sewer Project. The applicant will need to consult with the Department of <br /> Public Works to determine the number of sewer allotments available. <br /> Water System <br /> Development Title Section 9-1120.3(a) states that subdivisions in an urban community with <br /> parcels less than two (2) acres shall be served by a public water system. California Water <br /> Service provides water service to the area. A "will serve" letter will be required from California <br /> Water Service upon submittal of a full application, verifying that these services are available. <br /> Storm Drainage <br /> Development Title Section 9-1135.3(a) states that subdivision drainage facilities shall discharge <br /> into a terminal drain, except that an agency retention basin may be an acceptable alternative <br /> where permitted by a Master Plan or Special Purpose Plan. The applicant will need to consult <br /> with the Department of Public Works to determine the logistics of connecting to a terminal drain. <br /> 3 <br />
