Recommendations <br /> Action <br /> It is recommended that the Planning Commission deny Use Permit No. UP-98-18 based on the inability to <br /> make Finding No. 4 contained in the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan; <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan; and any other applicable <br /> plan adopted by the County. <br /> • This finding can be made because the "Farm Labor Camp" use type is consistent with <br /> the A/G General Plan designation and in turn may be conditionally permitted with a <br /> Use Permit in the AG-40 zone. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and otltier <br /> necessary facilities have been provided, and the proposed improvements are properly related to <br /> existing and proposed roadways. <br /> • This finding can be made because the applicant has proposed the use of an on-site <br /> water well and package sewage treatment system to be approved by Public Health <br /> Services, and stormwater will be retained on the site. In addition, the project has <br /> public road frontage on Harney Lane. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the plan shows that there is sufficient area for the <br /> new facilities, parking, and circulation, in compliance with County standards. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare <br /> or be injurious to the property or improvements of adjacent properties. <br /> • This finding cannot be made because the security plan submitted by the applicant has <br /> been deemed unsatisfactory by the County Sheriff's Office. <br /> 5. The use is compatible with adjoining land uses. <br /> • This finding can be made because with the location of the facility and the buffer areas <br /> between the facility and adjacent properties, the proposed use will not interfere with or <br /> alter the current agricultural and land fill uses on adjacent properties. <br /> San Joaquin County UP-98-18\Rios <br /> Community Development Page 5 <br />
