A copy of Specific Plan II can also be reviewed <br /> at this County office. <br /> 7. The County is the lead agency for the Mountain House Master Plan and <br /> was identified as such in the 1994 MEIR. The County is also the lead agency for all subsequent <br /> land use approvals contemplated by the Master Plan, including the Project. <br /> 8, The 1994 MEIR was certified in 1994. CEQA Guidelines 15177 of the <br /> CEQA Guidelines addresses subsequent projects within the scope of the 1994 MEIR and states <br /> that new environmental documentation (except as stated in "b" below) or findings are not required <br /> when specific requirements are met. These requirements include the following: (a)The lead <br /> agency for the MEIR is the same as for the subsequent project; (b)The lead agency prepares an <br /> Initial Study on the subsequent project to determine if any additional significant effect on the <br /> environment could occur that was not addressed in the MEIR; and (c)The lead agency <br /> determines, on basis of written findings, that no additional significant environmental effect would <br /> result, that no new mitigation measures are needed, and that the project is within the scope of the <br /> MEIR- Here, the lead agency for the MEIR is the same as that for the Project—the County, an <br /> Initial Study has been prepared, and the County, as lead agency has determined that a Mitigated <br /> Negative Declaration was required. <br /> 9. CEQA Guidelines 15179 states that an Initial Study done for a project <br /> that was the subject of a MEIR must make the following findings if more than five years have <br /> elapsed since certification of the MEIR: (a)There have been no substantial changes with respect <br /> to the circumstances under which the MEIR was certified; or(b)There is no new available <br /> information that was not known and could not have been known at the time the MEIR was <br /> certified. If this determination cannot be made, the standard Initial Study process will be used to <br /> determine the scope of an EIR for the project, or the need for a Mitigated Negative Declaration. <br /> Here, the 2011 Initial Study prepared for the Project concluded that, based on new available 1.01 <br /> information, some potentially significant impacts could result from the Project. In addition, the <br /> CEQA Guidelines have been amended since the MEIR was prepared and new topics such as <br /> greenhouse gas (GHG) emissions were evaluated. Accordingly, a Mitigated Negative Declaration <br /> was determined to be appropriate and one was prepared (the 2011 IS/MND). <br /> 10. The County provided notice pursuant to Public Resources Code section <br /> 21092 and CEQA Guidelines 15072 that the 2011 IS/MND was prepared for the Project. The <br /> notice specified that, pursuant to CEQA Guideline 15073, the 30 day public review and comment <br /> period for the 2011 IS/MND commenced on September 16, 2011, and closed on October 17, <br /> 2011, and that a hearing was tentatively scheduled before the County on December 1, 2011. The <br /> notice included a description of the Project as well as a list of the significant environmental effects <br /> anticipated as a result of the Project. It further stated that the 2011 IS/MND, along with all <br /> supporting documentation, would be available for review during regular business hours at the <br /> Community Development Department, 1810 East Hazelton Avenue, Stockton, California 95205. <br /> The notice was mailed to all parties who had previously requested notice. The notice was posted <br /> with the County Clerk on September 15, 2011, and mailed to the State Clearinghouse on <br /> September 15, 2011. A legal ad was place in the Stockton Record on November 21, 2011. The <br /> notice was mailed to property owners, surrounding property owners, adjacent residents and <br /> interested parties on November 18, 2011. <br /> 11. All comments received with regard to the 2011 IS/MND during and after <br /> the period of public review have been duly considered in accordance with the provisions of <br /> CEQA. <br /> 2 <br />
