The adjacent properties to the east, west, and <br /> south are owned by, and located in, the City of Tracy and are developed with municipal <br /> facilities. <br /> Agricultural Mitigation <br /> This project includes a Zone Reclassification application that proposes to change the permitted land use from <br /> an agricultural to a nonagricultural land use. Pursuant to Development Title Section 9-1080.3(a)(2), a Zone <br /> Reclassification that changes the permitted uses of a parcel from an agricultural to a nonagricultural use <br /> shall require agricultural mitigation. <br /> Pursuant to Development Title Section 9-1080.3(c), agricultural mitigation shall be satisfied by granting a <br /> farmland conservation easement or other farmland conservation mechanism set forth in San Joaquin County <br /> Development Title Section 9-1080.3(d) to or for the benefit of a Qualifying Entity. Pursuant to Development <br /> Title Section 9-1080.3(f), final approval of any project subject to agricultural mitigation is contingent upon <br /> the execution of the legal instrument to provide agricultural mitigation land and payment of the <br /> administrative fee, or approval and payment of an in-lieu fee. Issuance ofl-a building or grading permit for <br /> the parcel will require submission of the required legal instrument.
