Mr. Malcoun mentioned that the applicants could restrict the use of the property with a deed
restriction. This would ensure that the usage restrictions would apply to the current use, and
could not be expired, exchanged or modified without meeting the General Plan polices or
needing permission from the Community Development Director. Something could be worked
out with legal counsel.
Mr. Malcoun indicated that the property has been used historically for trailer parking, and that
employees are only on site to hookup a trailer, pull it out and then lock up the gate. The property
site is not used for repairs, and only trailers are stored.
Mr. Malcoun informed the Development Committee that Mr. Silva has been using the property
for trailer parking since 1975, and he purchased the property in 1976. Mr. Malcoun said he does
not know what the General Plan allowed in 1975 and that he would have to do some research to
see if the General Plan permitted trailer parking in an agriculture zone in 1975. Mr. Martin
indicated that if the General Plan did allow for trailer parking in an agriculture zone in 1975 then
Mr. Silva could apply in for a Site Approval to establish the business as a legal non-conforming
use. Mr. Martin suggested that Mr. Malcoun check with Mr. Van Buren of the Community
Development Department regarding the history of the property.
Mr. Martin informed the applicant that the Community Development Department will be
recommending denial at the Planning Commission hearing.
Ms. Jolley indicated that she would take the project off of the Planning Commission hearing
agenda for the May 3rd meeting, and would reschedule the item when the soil suitability study
has been completed.
---------------------------------------------------------------------------------------------------------------------
The meeting was adjourned at 11: 30 a.m. l
DEVELOPMENT COMMITTEE CHANDLER MARTIN
CHAIRMAN
C: Ben Hulse, Director Steve Lima
Kerry Sullivan, Deputy Director Paulette Lima
Chandler Martin, Senior Planner Rod Hawkins
Jeff Fisher,Associate Planner Steven Page
Jennifer Jolley, Associate Planner Daniel Place
Kermit Darrow,Building Division Dwight Petersen
Gabriel Karam, Public Works Department David Silva
Ray Borges, Environmental Health Division Steve Malcoun
Johnny Yoakum, Environmental Health Division
Don Mann, Sheriffs Department
Lanny Bowden
