Recommendations _ <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Mitigated Negative Declaration; <br /> 2. Approve the Reclamation Plan; and <br /> 3. Approve Quarry Excavation Permit No. QX-99-1 subject to the Findings and Conditions of <br /> Approval contained in the staff report. <br /> Findings <br /> 1. The proposal is for the removal of regionally significant or scarce deposits of mineral resources and not <br /> for the removal of prime farmland. <br /> • This finding can be made because the project site is located within an MRZ-3 zone,which is <br /> an area with potentially significant resource deposits, topsoil will be stockpiled, and <br /> because the site will be returned to agricultural use following reclamation of the excavated <br /> areas of the project site. <br /> 2. The proposed reclamation of the property upon completion of the excavation will leave the property in a <br /> condition that will allow its reuse. <br /> • This finding can be made because the site will be reclaimed in accordance with the <br /> Reclamation Plan prepared by George Reed, Inc., by recontouring the mined area and <br /> planting the site with walnut trees to prepare the site for agricultural use. <br /> 3. Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare or be <br /> injurious to the property or improvements in the vicinity. <br /> • This finding can be made because all of the potentially significant, adverse environmental <br /> impacts associated with the project can be mitigated to less than significant levels. <br /> San Joaquin County QX-99-2\Reed <br /> Community Development Page 6 <br />
