III. COUNTY COUNSEL <br /> 1. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider <br /> shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from <br /> any claim,action, or proceeding against the local agency or its agents, officers, or employees to attack, <br /> set aside,void, or annul an approval of the local agency, advisory agency, appeal board, or legislative <br /> body concerning a subdivision,which action is brought within the time provided for in Section 66499.37 of <br /> the Government Code. <br /> IV. DEPARTMENT OF PUBLIC WORKS (Staff Contact: Alex Chetley, 209-468-3000) <br /> 1. The Traffic Impact Mitigation Fee will be required when parcels are developed. The fee is due and <br /> payable at the time of building permit application. <br /> NOTES: <br /> (i.) Any construction activity that results in the disturbance of at least one(1)acre of soil shall require <br /> a State NPDES construction permit. Dischargers whole projects disturb 1 or more acres of soil or <br /> whole projects disturb less than one (1)acre of soil and is not part of a larger plan of <br /> development, are required to obtain coverage under the current General Permit for Discharges of <br /> Storm Water Associated with Construction Activity <br /> (www.swrcb.ca.gov/stormwtr/gen_const.html#const permit). Construction activity subject to this <br /> permit includes clearing, grading and disturbances to the ground such as stockpiling, or <br /> excavation, but does not include regular maintenance activities performed to restore the original <br /> line, grade, or capacity of the facility. <br /> (ii.) All future building permits for projects located within a Special Flood Hazard Area at the time of <br /> permit issuance shall meet the San Joaquin County flood hazard reduction requirements (Title 9, <br /> Chapter 9-1605)and all requirements of the State of California (CCR Title 23)that are in force at <br /> the time of permit issuance. As an example, these requirements may include raiding the finish <br /> floor elevation one foot above the expected flood level and/or using flood resistant materials. <br /> V. ENVIRONMENTAL HEALTH DEPARTMENT (Staff Contact: Ted Tasiopoulos, <br /> 209-953-7698) <br /> 1. A qualified environmental professional shall prepare a surface and subsurface contamination report, <br /> identifying any potential source of surface or subsurface contamination caused by past or current land <br /> uses. The report shall include evaluation of non-point source of hazardous materials, including <br /> agricultural chemical residues, as well as potential point sources, such as fuel storage tanks, septic <br /> systems, or chemical storage areas. The report shall be submitted to the Environmental Health <br /> Department at time of submittal of a tentative map (San Joaquin County Development Title, Section <br /> 9-905.12). <br /> A review fee of$250 shall be paid at the time of submittal to the Environmental Health Department. <br /> NOTE: The Environmental Health Department received a report dated November 30, 2004. Prior to <br /> recordation of Final Map, an addendum shall be submitted to the Environmental Health Department <br /> and approved by the Environmental Health Department. <br /> 2. Connection to a public sewer system is required (San Joaquin County Development Title, Section 9- <br /> 1105.2[b]). <br /> 3. Connection to an approved public water supply system is required (San Joaquin County Development <br /> Title, Section 9-1120.2) <br /> 21 <br />
