5. Neither the design of the subdivision nor any proposed improvements are likely to cause substantial <br /> environmental damage or substantially and avoidably injure fish or wildlife or their habitat. <br /> This finding can be made because the Initial Study prepared for this project did not <br /> identify any known rare or endangered species or habitats or other substantial <br /> environmental adverse effects. In addition, the project site is located within San Joaquin <br /> County Council of Gcvernment's 'No Pay' Zone, and therefore, no mitigation will be <br /> required. <br /> 6. The design of the subdivision or type of improvement is not likely to cause significant public health <br /> problems. <br /> This finding can be made because the Department of Public Works determined the City of <br /> Stockton can provide sanitary services through the East Stockton SSP to the proposed <br /> subdivision and storri drainage service for the proposed subdivision will be provided by <br /> Caltrans. In addition, the California Water Service Company has provided a "will-serve" <br /> letter stating water service can be provided to the proposed subdivision <br /> 7. The design of the subdivis on or the types of improvements will not conflict with easements acquired <br /> by the public at large for access through or use of property within the proposed subdivision. <br /> • This finding can be made because there are no conflicts with the design of the proposed <br /> parcels, and the existing Pacific Gas and Electric easement and Public Utility easement <br /> are within the proposed twenty foot private road access easement. <br /> 8 Any land or improvements to be dedicated to the County or other public agency is consistent with the <br /> General Plan, any applicable Specific Plan and Special Purpose Plan, and any other applicable plan <br /> adopted by the County <br /> • This finding can be made because there is no land to be dedicated to San Joaquin County <br /> for public roadways. Additionally, there are no applicable Specific Plans or Special <br /> Purpose Plans. <br /> 9. The design of the subdivis on provides, to the extent feasible, for future passive or natural heating or <br /> cooling opportunities in the subdivision, as required by Government Code Section 66473 1 <br /> • This finding can be made because the lots are large enough so that individual dwellings <br /> can be situated to take advantage of solar energy. <br /> San Joaquin County, PA-0600062/Lucas <br /> Community Development Page 5 <br />
