On March 13, 2002, the Community Development Department approved Site Approval <br /> Application No. SA-01-91 to remodel the existing non-conforming mobile home park. On <br /> March 25, 2002, the previous applicant appealed staff's action to the Planning <br /> Commission. On May 16, 2002, the same applicant withdrew the appeal. The property <br /> has recently changed ownership and the new applicant will be required to comply with <br /> the previously approved conditions of approval. <br /> Non-Conforming Use <br /> Development Title Section 9-235.3(a & c) states that if a non-conforming use is <br /> superseded by a conforming use, or if the non-conforming uses ceases for any reason <br /> for a period of more than twelve (12) consecutive calendar months, any subsequent use <br /> shall conform to the requirements of this Title for the zone in which it is located and the <br /> non-conforming use may not thereafter be resumed. In addition, a non-conforming use <br /> not conducted within a structure but on land only, shall not be changed to another non- <br /> conforming use. <br /> As a result, if the conditions of approval are not completed within the time allotted, the <br /> non-conforming use will cease and any new development will be required to comply with <br /> the current Development Title regulations for development in the AG-40 zone. <br /> The Community Development Department has reviewed the request for a one-year time <br /> extension and will approve the extension subject to the previously approved conditions <br /> of approval. <br /> Site Approval Application No. SA-01-0091 was approved by the San Joaquin County <br /> Community Development Department on March 13, 2002. The effective date of approval is <br /> March 23, 2002. This approval will expire on September 22, 2003, which is 18 months from <br /> the effective date of approval, unless (1) all Conditions of Approval have been complied <br /> with, (2) all necessary building permits have been secured and remain in force, and (3) all <br /> necessary permits from other agencies have been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be <br /> fulfilled prior to the establishment of the use and the issuance of any building permits. <br /> Those Conditions followed by a Section Number have been identified as Ordinance <br /> requirements pertinent to this application. Ordinance requirements cannot be modified, and <br /> other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Jennifer Jolley, 468-3161) <br /> a. BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING PERMIT'. The <br /> Site Plan required as a part of the building permit must be prepared by a registered civil <br /> engineer or licensed architect. This Plan must show drainage, driveway access details <br /> (including gates), on-site parking, landscaping, signs, existing and proposed utility services, <br /> and grading (refer to the "SITE PLAN CHECK LIST" for details). A fee is required for the <br /> Site Plan review. (Development Title Section 9-884) <br /> b. APPROVED USE: This approval is to remodel an existing non-conforming mobile home <br /> park. The remodel is to include a complete septic reconstruction with replacement area and <br /> reduce the number of mobile homes spaces from 24 to 18 (see Development Title Section <br /> 9-235.3[a][2]) (Use Type: Mobile Home Park). <br /> c. BUSINESS LICENSE: The applicant shall secure an approved Business License prior to <br /> the initiation of the use.
