The type of financial guarantee may be, but is not limited to, the f 1 <br /> following: <br /> (1) A faithful,-performance bond. <br /> f. <br /> (2) A property escrow or escrow account. <br /> -a <br /> (3) A trust fund. <br /> c. Prior to commencement of operations, a revegetation plan shall be approved by,the Department of <br /> Fish and Game. A copy of this approved plan shall be submitted to the Planning Division. <br /> d. Final elevatiobs within 25 feet of any property boundary must be equal to or greater than the abutting <br /> property unless the elevation prior to excavation is less than that of the abutting'property, in which <br /> case the differential shall not be increased. <br /> is <br /> e. Final slopes.cannot exceed 1-112 feet horizontal to 1 foot vertical. <br /> r <br /> f. All water utilized in the plant operation must be disposed of behind a closed dike. <br /> g. Stockpiled soil or material cannot be stored within 25 feet of a property boundary. <br /> h. Private roadsinvolved in the excavation must be maintained to control the creation of dust. The first <br /> 100 feet of any private road on the property which intersects with a publicly maintained road must be <br /> surfaced in a:manner approved by the agency responsible for the maintenance of the public road. <br /> Traffic-control and warning signs are required at the intersection. The placement, size, and wording <br /> of these signs;must be approved by the agency responsible for the maintenance of the public road. <br /> i. Excavation operations shall not be carried on during the hours from 9:00 p.m. through 5:00 a.m., <br /> except during,periods of declared national, state, or local emergency. The hours shall be based on <br /> either Pacific:Standard Time or Pacific Daylight Saving Time, whichever is legally in effect. <br /> j. Any night IigFting established on the property must be arranged and controlled so it will not illuminate <br /> or cause anyplare onto public rights-of-way or adjacent properties. <br /> k. All emissionsare subject to the rules and regulations of the San Joaquin Air Pollution Control District. <br /> !. Operations shall be in accordance with instructions from the Agricultural Commissioner to control the <br /> spread of noxious weeds. <br /> 3;- <br /> m. The excavation must not cause health or sanitary hazards and shall not create conditions which will <br /> cause the breeding or increase of mosquitoes, rodents, or other pests. <br /> n. The operating:practices utilized must minimize noise, vibration, dust, and unsightliness. <br /> o. The rehabilitation of each phase shall be completed, in conformance with the rehabilitation plan, <br /> within two years of completion of the extraction portion of that phase. <br /> p.
