ENVIRONMENTAL ANALYSIS <br /> 4.2 LAND USE - <br /> development and quarry excavation standards including requirements for setbacks, stockpiles, _ <br /> operating conditions, and fencing and landscaping.Compliance with these regulations,including <br /> but not limited to Sections 9-600 through 9-610,9-851, 9-854,and 9-1400 through 9-1415 of the <br /> Development Title will ensure that the Proposed Project is consistent with the County Zoning — <br /> Code and with SMARA. In addition, the project conditions included in the project description as <br /> well as implementation of the mitigation measures included in this EIR will ensure that that the <br /> Proposed Project fulfills the requirements set forth in the Agricultural Land Use and Quarry - <br /> Mining sections of the Zoning Code. <br /> Stanislaus County General Plan <br /> The development of mining operations and aggregate processing facilities at the project site is <br /> generally consistent with the current Stanislaus County General Plan designation of Agriculture. — <br /> Although intended primarily for agricultural use,this designation allows for uses that are not <br /> compatible with urban uses-- including the management and procurement of mineral resources-- <br /> provided that they do not conflict with agriculture. <br /> Consistent with General Plan Land Use Policies 2 and 14,use of the project area will be limited <br /> to activities compatible with agriculture,including natural resource management. Consistent with <br /> the General Plan Land Use Policy 17,development of the proposed quarry will promote the <br /> diversification of the local economy. Finally, consistent with Land Use Policy 18, <br /> implementation of the Proposed Project will accommodate the siting of an industry with unique <br /> requirements. For a discussion of General Plan consistency for other environmental resource <br /> areas,the reader is directed to the individual sections of this Draft EIR. <br /> Stanislaus County Zoning Ordinance <br /> As a condition of project approval,the Proposed Project will be required to comply with the <br /> agricultural land use and quarry and mining land use regulations specified in the Stanislaus <br /> County Zoning Code. Chapter 21.20.030 of the Zoning Code identifies earth and/or mineral <br /> extraction as"Tier Three"land use,which, although not directly related to agriculture,may be <br /> allowed providing the use is not seriously detrimental to surrounding agriculture,and that the <br /> land may be reasonably returned to agricultural use in the future. Under the Zoning Ordinance, <br /> the Proposed Project will need to obtain a use permit and approval by the Planning Commission. <br /> In addition,Chapter 21.88 of the Zoning Ordinance incorporates the regulations defined under _ <br /> SMARA,and requires the Proposed Project to meet applicable standards,including,but not <br /> limited to those regarding reclamation,findings for approval,financial assurances, inspections, <br /> and mineral resource protection. _ <br /> Compliance with the above regulations will ensure that the Proposed Project is consistent with the <br /> County Zoning Code.
