ENVIRONMENTAL ANALYSIS <br /> 4.11 HAZARDS AND HAZARDOUS MATERIALS <br /> issued NPDES construction activity storm water permits would be taken to ensure that no <br /> hazardous materials enter any nearby waterways. <br /> Significance after Mitigation: Less-than-significant. <br /> Impact 4.113: The Proposed Project would involve the installation and use of above- <br /> ground fuel storage tanks,and the storage and use of hazardous materials. This would be a <br /> less-than-significant impact. <br /> The owners and operators of above-ground storage tanks are required to comply with all laws and <br /> regulations with respect to the design,construction and monitoring requirements for new and <br /> existing above-ground storage tanks. <br /> Due to the current laws and regulations that the project applicant would be required to comply <br /> with regarding above-ground fuel storage tanks and hazardous materials, the Proposed Project <br /> would be consistent with all applicable policies of the San Joaquin County General Plan and the <br /> Stanislaus County General Plan with regards to hazardous materials. <br /> A HMMP would be prepared and submitted to both the San Joaquin County Environmental <br /> Health Department and the Stanislaus County Environmental Health Department. This plan <br /> would include an inventory of hazardous materials and hazardous wastes, as well as an <br /> emergency response to incidents involving those hazardous materials and wastes. The plan <br /> would be located on the property at all times and employees would be trained on the details of the <br /> plan. <br /> Current federal regulations(40 C.F.R. § 112,et seq.)require operations storing more than <br /> 1,320 gallons of petroleum products to have a Spill Prevention Control and Countermeasure Plan <br /> _ (SPCC). The Aboveground Petroleum Storage Act Program, administered by the State Water <br /> Resources Control Board,requires owners or operators of aboveground storage tanks to: <br /> • File a storage statement defining the quantity of petroleum stored on-site(applies to a <br /> single petroleum tank that stores greater than 660 gallons of petroleum product,or facilities <br /> with a cumulative petroleum storage capacity of greater than 1,320 gallons). <br /> �. • Pay a bi-annual facility fee. <br /> • Prepare and implement a Federal SPCC Plan. A registered professional engineer must <br /> r certify the SPCC plan and a complete copy maintained on the site at all times. <br /> A SPCC will be required to be prepared for the site in accordance with 40 CFR 112, and the State <br /> ` Aboveground Petroleum Storage Act program. The SPCC Plan will address the liquid petroleum <br /> products that are stored and used at the site, and provide the procedures for the prevention of <br /> discharge of the products into any on-site waters.
