4.2 Land Use r Impact 4.2.2: The project is consistent with applicable Land Use designations and policies. This would be a less-than-significant impact. The following section discusses any inconsistencies between the project and existing adopted plans, policies, and land use designations. The consistency analysis considers the adopted goals and policies of the various plans identified in the setting discussion. San Joaquin County General Plan The development of mining operations and aggregate processing facilities at the project site is generally consistent with the current General Plan Designation of General Agriculture(A/G)and Open Space Resource Conservation(OS/RC). The General Agriculture(A/G)designation specifically allows mining activities with the appropriate permits. General Plan Agricultural .. Lands Policy 5 allows non-farm activities within agricultural areas provided that the use is dependent on a specific location or resource orientation. Non-farm activities must not negatively impact surrounding agricultural uses,must minimize agricultural disruption, and must incorporate adequate buffers. Mining operations are also proposed to occur within areas designated as Open Space Resource Conservation(OSRC). This designation protects areas with significant resources, including mineral resources,from premature or incompatible development. Extraction of gravel and sand deposits,followed by agricultural reclamation is consistent with this designation. However, 6. pursuant to the requirements associated with development in an OSRC designated-area, a discretionary use permit will be required as a condition of approval for the project. L The project is generally consistent with the applicable goals and policies contained within the San Joaquin County General Plan. Mitigation measures are proposed throughout this FIR to account r for any new significant nuisances, hazards, or other adverse environmental impacts. In addition, surface mining operations are not directly adjacent to any existing rural residences. As part of the project,a minimum setback of 50 feet, including landscape screening, berming, and fencing,will ` be provided between surface mining operations and adjacent land uses (see Section 3.6.1, Landscaping and Screening), consistent with the General Plan Agricultural Lands Policy 10.The 50-foot buffer will help reduce effects, including visual impacts and noise. f. Also,consistent with the General Plan Mineral Resources Policy 2,the project applicant will reclaim mined areas as soon as possible. Finally,consistent with the General Plan Open Space Policy 3,development of the project area will be for the use of the resource. San Joaquin County Zoning Code ` As a condition of project approval, the project will be required to comply with the agricultural land use and quarry and mining land use regulations specified in the San Joaquin County Development Title. These regulations establish permit requirements and procedures, and ` development and quarry excavation standards including requirements for setbacks, stockpiles, operating conditions, and fencing and landscaping.
