1%%w4 ]ettiai Study—LID Annexation <br /> Resources Board(ARB), and National Oceanographic and Atmospheric Administration(NOAA), as well <br /> as previously certified EIRs. <br /> 2.3.1 Regulatory Background <br /> Air quality at the proposed project site is regulated by several jurisdictions, including the EPA,ARB, <br /> City of Lathrop and SJVAPCD.The state,regional,and local jurisdictions develop rules, regulations, <br /> policies,or plans to achieve the goals and directives imposed through legislation that shall not supersede <br /> those developed by the EPA but may be more stringent. Ambient air quality is described in terms of <br /> compliance with state and national standards.Ambient air quality standards indicate the air pollutant <br /> concentration considered safe for the protection of public health and welfare.These standards are <br /> designed to protect people who are sensitive to respiratory distress, such as asthmatics,the elderly, <br /> children,people already weakened by other disease or illness,and persons engaged in strenuous work or <br /> exercise.National Ambient Air Quality Standards(NAAQS)originally were established by the EPA in <br /> 1971 for six air pollution constituents.The NAAQS have been periodically revised since 1971. Each <br /> individual state possesses the authority to add other pollutants,to require more stringent compliance,or to <br /> include different exposure periods. <br /> The SJVAPCD is the agency primarily responsible for ensuring that NAAQS and CAAQS are not <br /> exceeded and that air quality conditions are maintained in the San Joaquin Valley Air Basin(SJVAB). <br /> The responsibilities of the SJVAPCD include,but are not limited to, preparing plans for the attainment of <br /> ambient air quality standards, adopting and enforcing rules and regulations concerning sources of air <br /> pollution, issuing permits for stationary sources of air pollution, inspecting stationary sources of air <br /> pollution and responding to citizen complaints, monitoring ambient air quality and meteorological <br /> conditions,and implementing programs and regulations required by the federal Clean Air Act(CAA)and <br /> the California Clean Air Act(CCAA). In an attempt to achieve NAAQS and CAAQS and maintain air <br /> quality,the SJVAPCD has completed the following air quality attainment plans and reports: 1994 Ozone <br /> Attainment Demonstration Plan(amended in 2001), 1997 PM,Attainment Demonstration Plan, <br /> 1997-1999 PM, Progress Report,2000 Ozone Rate of Progress Report,2000 Annual Progress Report,and <br /> the 2000 Triennial Plan. <br /> The City of Lathrop General Plan and EIR includes several policies specifically related to air quality.The <br /> following policy from the "Air Quality and Solid Waste Management Policies"section of the General <br /> Plan applies to the proposed project: <br /> "The City shall require positive control of dust particles during project construction activities, <br /> including watering or use of emulsions,parking of heavy equipment on paved surfaces, <br /> prohibition of land grading operation during days of high wind(beginning at 10 mph,with gusts <br /> exceeding 20 mph),and prohibitions of burning on vacant parcels." <br /> 2.3.2 Air Quality Impacts <br /> Potentially Less Than Less Than No <br /> Significant Significant with Significant Impact <br /> Impact Mitigation Impact <br /> Incorporation <br /> III.
