b. The deed restrictions should include the following: <br /> (1) The U. S. Army Corps of Engineers has jurisdiction over waters of the United States under the <br /> authority of Section 404 of the Clean Water Act. No discharge of dredged or fill material into <br /> waters of the United States is allowed without prior Department of Army approval. Any <br /> discharge of dredged or fill material into the identified wetland areas, as depicted on the verified <br /> wetland delineation map may require a DA permit. <br /> (2) Attach a verified wetland delineation map. <br /> 3. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision, which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br /> 4.
