ti <br /> h. All emissions shall be subject to the rules and <br /> regulations of the San Joaquin County Air Pollution <br /> Control District. (Planning Title Section 9-2224{f} ) <br /> i. If noxious weeds are on the site, operations shall be in <br /> accordance with instructions from the Agricultural <br /> Commissioner of San Joaquin County. (Planning Title <br /> Section 9-22241h}) <br /> j . Any night lighting established on the property shall be <br /> arranged and controlled so as not to illuminate public <br /> rights-of-way or adjacent properties. (Section 9-2244{e} ) <br /> k. Excavations shall not cause health or sanitary hazards <br /> and shall not create conditions which will cause the <br /> breeding or increase of mosquitos, rodents, or other <br /> pests. (Section 9-2244{i} ) <br /> 1. A written notification of work schedules and an <br /> Improvement Plan shall be provided to the County by the <br /> applicant prior to any grading or excavation. (Planning <br /> Title Section 9-2224{j }) The Improvement Plan shall <br /> reflect all of the adopted Conditions of Approval. <br /> M. At the completion of the grading, the applicant shall <br /> have a registered civil engineer or licensed land <br /> surveyor compare the excavation's final elevations with <br /> the approved permit. The engineer or surveyor shall <br /> submit a certified, written finding to the Planning <br /> Division which states and documents the compliance or <br /> non-compliance of the excavation with all of the <br /> conditions of the approved permit, including <br /> documentation that fertilization has been completed per <br /> the laboratory recommendations submitted by applicant. <br /> (Section 9-2224{k} ) <br /> n. To insure that the excavation is completed in conformance <br /> with the approved permit, the operator shall secure a <br /> performance bond or other financial security sufficient <br /> to cover the cost of rehabilitation of the site for <br /> agricultural use. The form of the bond or other <br /> financial security shall be found acceptable by County <br /> Counsel. (Section 9-2224{m}) <br /> o. The applicant shall not be required to replace the site' s <br /> topsoil and excavated material may be removed from the <br /> site without stockpiling, following the County' s <br /> acceptance of the performance guarantee. <br /> 2 . PUBLIC HEALTH SERVICES <br /> a. No excavation is permitted into the ground water table <br /> without specific approval from the Regional Water Quality <br /> Control Board, Central Valley Region, Porter-Cologne <br />
