i <br /> Wildlife: One neighbor expressed opposition to the project because the neighbor has a San Joaquin <br /> Council of Governments (COG) habitat conservation easement to protect Swainson's hawk on his <br /> property east of the project site. He is concerned the paintball gun firing and netting would negatively <br /> affect the preserve. COG submitted a letter dated July 13,2011 expressing concern regarding the Impact <br /> to the easement and potential sensitive habitats in the area. COG requested signs and instructions be <br /> clearly posted to prevent patrons from shooting at the wildlife_ Additionally, COG stated netting should be <br /> kept to a minimum to avoid entrapment of wildlife. The nearest paintball field is located approximately 160 <br /> feet west of the easement and is separated by a 20-foot in height paintball net and Paradise Avenue. <br /> The applicant indicated signs will be posted with rules and players will be accompanied to the field by <br /> trained referees. Additionally,the facility will use paintballs that have a lower range and will not travel <br /> more than 50 feet before losing momentum and landing on the ground, which will ensure impacts to <br /> wildlife are less than significant.The applicant has indicated he will participate in COG's Habitat <br /> Conservation Program. COG also Indicated, prior to commencement of any construction activities, the <br /> applicant is required to consult with the U.S. Fish and Wildlife Service under Section 7 or Section 10 of <br /> the Endangered Species Act. This requirement has been incorporated as a Condition of Approval. <br /> Agency Res onse Letters <br /> Farm Bureau-The Farm Bureau sent a letter dated June 10, 2011 and requested denial of the <br /> application because the paintball field represents a non-compatible recreational use In an actively farmed <br /> area that is zoned for agricultural activities. However, pursuant to Development Title Table 9-603.2, the <br /> Recreation-Outdoor Sports Club is a conditionally permitted use in the agricultural zone subject to an <br /> i approved Site Approval application and is therefore, not in conflict with agricultural uses. <br /> Pescadero Reclamation District#2058-The Pescadero Reclamation District#2058 submitted a letter <br /> dated June 13, 2011 stating the use is not a good fit for the zoning of the property and the facility's <br /> drainage can not enter in their waterways. As previously discussed,the land use is conditionally <br /> permitted and drainage is required to be contained on-site. <br /> Delta Protection Commission-The project site is located in the Secondary Zone of the Delta and is <br /> located one mile south of the Primary Delta Zone. The Delta Protection Commission-submitted a letter <br /> dated June 14, 2011 stating, although the Commission has no jurisdiction over local action in the <br /> Secondary Zone,the project should be evaluated for its impacts on loss of farmland,wildlife habitat, <br /> degradation of water quality, and demands on infrastructure. The wildlife habitat,water quality and <br /> demands on infrastructure are previously discussed in the Staff Report. Regarding loss of farmland, the <br /> project site will encompass 17-acres of a 51-acre parcel which currently contains alfalfa grass. The <br /> remaining 34 acres of parcels will continue to be farmed and used for animal raising and farm ranching <br /> activities. The surrounding land uses are primarily agricultural operations and there will be no <br /> modification to existing drainage or irrigation systems which support agricultural uses on adjacent lands. <br /> The Initial Study prepared for the project found no potentially significant environmental impacts. <br /> San Joaquin County PA-1100062IPinto <br /> Community Development Page 5 <br />
