area will be required to be surfaced with asphalt concrete or Portland cement concrete <br /> as a condition of approval. <br /> Riparian Habitat <br /> Development Title Section 9-1510.5 states that parallel to any natural bank of a <br /> waterway, a natural open space for riparian habitat and waterway protection shall be <br /> maintained to provide nesting and foraging habitat and the protection of waterway <br /> quality. The minimum width of said open space shall be one-hundred (100) feet, <br /> measured from the mean high water level of the natural bank or fifty (50) feet back from <br /> the existing riparian habitat, whichever is greater. Water dependent uses may be <br /> permitted in this buffer. Duck Creek bisects the project site running east to west. The <br /> creek has a General Plan designation of OS/RC and appears to have the potential for <br /> riparian habitat. As a result, the ordinance requirement stated above is included as a <br /> condition of approval (1.n.). The creek is not expected to be impacted by the project <br /> because it is at least 350 feet north of any project related development. However, the <br /> condition of approval will ensure that future development will not impact potential riparian <br /> habitat along Duck Creek. <br /> End of Use <br /> The use type Stable-Commercial may be conditionally permitted in the AU-20 zone with an <br /> approved Use Permit. Because the project parcel is located within the Enterprise Zone, the <br /> Use Permit application which is reviewed using the Public Hearing Review Procedure <br /> (Development Title Chapter 9-220) has been reduced to a Site Approval application which <br /> is reviewed using the Staff Review with Notice Procedure (Development Title Chapter 9- <br /> 215). Volume I of the General Plan states that except for agricultural and residential uses, <br /> uses allowed within the Agriculture-Urban Reserve Zone must be consistent with the <br /> underlying General Plan designation. Consistency shall be determined based on whether <br /> or not the proposed use is allowed in an urban zone that implements the General Plan <br /> designation (1. Growth Accommodation, Implementation 5., pg. IV-11). Because the R/L <br /> General Plan designation does not permit the proposed use type, the following condition of <br /> approval shall apply: <br /> END OF USE: Within five (5) years from the effective date of a Zone <br /> Reclassification that changes the zoning from AU-20 to a zone that does not permit <br /> the approved use, the approved use shall either be terminated or changed to a use <br /> that is consistent with the new zone, unless the permit is extended by the granting <br /> authority. <br /> The Community Development Department has reviewed the Site Approval application <br /> and responses from other agencies and will apply the following Conditions of Approval: <br /> Site Approval Application No. PA-03-597 was approved by the Community <br /> Development Department on . The effective date of approval is . This approval will <br /> expire on , which is 18 months from the effective date of approval, unless (1) all <br /> Conditions of Approval have been complied with, (2) all necessary building permits <br /> have been issued and remain in force, and (3) all necessary permits from other <br /> agencies have been issued and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements <br /> shall be fulfilled prior to the establishment of the use and the issuance of any <br /> building permits.
