DRAFT NO. 1 - DATE: February 15. 1991 <br /> SCHOOL FACILITY PROVISION AGREEMENT <br /> THIS AGREEMENT is entered into this—day of <br /> 1991, by and between the Lodi Unified School District of San Joaquin <br /> County (hereinafter "District") and Emil Atwood (hereinafter <br /> "Developer"). <br /> WITNESSETH <br /> WHEREAS, the Developer is the owner and/or developer of <br /> undeveloped real property (hereinafter "the development") located <br /> within the boundaries of District, more thoroughly described in <br /> Exhibit "A" attached hereto and incorporated by reference. <br /> WHEREAS, Developer desires to develop the undeveloped land <br /> to include a maximum of 26 single family residential units. <br /> WHEREAS, the development is expected to generate 12 K-6 <br /> students, 3 7-8 students and 6 high school students. <br /> 26 single family units X 0.45 student/SF unit = 12 K-6 students <br /> 26 single family units X 0.12 student/SF unit = 3 7-8 students <br /> 26 single family units X 0.23 student/SF unit = 6 9-12 students <br /> WHEREAS, school facilities are a part of the infrastructure <br /> necessary to serve the future residents of the development. <br /> WHEREAS, the development will have a direct impact on <br /> existing and future school facilities within District boundaries. More <br /> specifically, the development will require the District to provide an <br /> additional number of "seats" in new or existing facilities in direct <br />
