L n <br /> Initial Study <br /> The Initial Study has not been posted. Upon submittal of the revised site plan by the <br /> applicant with a revised project description, the Initial Study will be posted. Agencies will <br /> have thirty days to respond to the Initial Study. <br /> Access <br /> The applicant is proposing to have secondary access through a twenty-five foot wide <br /> access driveway from Eight Mile Road. The proposed secondary access is located on <br /> the adjacent parcel to the east and shall be acquired via a proposed Lot Line <br /> Adjustment. The adjacent parcel is currently under the Williamson Act and a Notice of <br /> Nonrenewal was filed on October 3, 2005. The Department of Conservation has <br /> recommended postponing the Lot line Adjustment until the land is out of contract. The <br /> contract will expire on March 1, 2016. The contract must expire prior to commencement <br /> of Phase IV or V. Recordation of a "Notice of Lot Line Adjustment" for the proposed Lot <br /> Line Adjustment is a prerequisite to obtaining a building permit for Phase IV or Phase V. <br /> The applicant shall have no right, vested or otherwise, to proceed with Phase IV or <br /> Phase V until said Notice of Lot Line Adjustment is recorded and all other prerequisites <br /> for Phase IV or Phase V are met. <br /> Approval of the Use Permit does not guarantee approval of the Lot Line Adjustment. <br /> Traffic Study <br /> A traffic study dated May 8, 2008 was conducted by Dowling Associates, Inc.. The study <br /> determined the highest level of traffic generated by the Church will be on Sundays <br /> between 10:00 a.m. and 11:00 a.m. The traffic study identified a significant impact to <br /> the intersection of Eight Mile Road and the project driveway intersection and concluded <br /> the southbound shared left-right lane should be split into separate, exclusive left and <br /> right turn lanes. The Department of Public Works has included this mitigation measure <br /> as a recommended Condition of Approval, With the implementation of this mitigation <br /> measure, the significant traffic related impact will be reduced to a less-than-significant <br /> level. <br /> Noise <br /> Development Title Table 9-1025.9 Part I lists Religious Assembly as a noise sensitive <br /> land use. A portion of the project site lies within the 65 dBL noise contour for North <br /> State Route 99 East Frontage Road. The 65 dB contour line along North State Route 99 <br /> East Frontage Road is located 779 feet from the side of the road pursuant to General <br /> Plan Table Ill.D-4A. Classroom building one is 400 feet away from the front property <br /> line and approximately 570 feet away from the road, which falls within the 65dB contour <br /> line. A noise study was conducted by J. C. Brennan &Associates, Inc. dated June 17, <br /> 2008 and concluded standard commercial construction practices consistent with the <br /> uniform building code will mitigate for interior traffic noise levels. The study also <br /> concluded a sound wall six feet in height should be constructed on the western edge of <br /> the children's play area if the children's play area is used at night. The applicant has <br /> stated the children's play area is only used during the daytime and therefore, no <br /> mitigation is required. <br /> 2 1 <br />
