L n
Initial Study
The Initial Study has not been posted. Upon submittal of the revised site plan by the
applicant with a revised project description, the Initial Study will be posted. Agencies will
have thirty days to respond to the Initial Study.
Access
The applicant is proposing to have secondary access through a twenty-five foot wide
access driveway from Eight Mile Road. The proposed secondary access is located on
the adjacent parcel to the east and shall be acquired via a proposed Lot Line
Adjustment. The adjacent parcel is currently under the Williamson Act and a Notice of
Nonrenewal was filed on October 3, 2005. The Department of Conservation has
recommended postponing the Lot line Adjustment until the land is out of contract. The
contract will expire on March 1, 2016. The contract must expire prior to commencement
of Phase IV or V. Recordation of a "Notice of Lot Line Adjustment" for the proposed Lot
Line Adjustment is a prerequisite to obtaining a building permit for Phase IV or Phase V.
The applicant shall have no right, vested or otherwise, to proceed with Phase IV or
Phase V until said Notice of Lot Line Adjustment is recorded and all other prerequisites
for Phase IV or Phase V are met.
Approval of the Use Permit does not guarantee approval of the Lot Line Adjustment.
Traffic Study
A traffic study dated May 8, 2008 was conducted by Dowling Associates, Inc.. The study
determined the highest level of traffic generated by the Church will be on Sundays
between 10:00 a.m. and 11:00 a.m. The traffic study identified a significant impact to
the intersection of Eight Mile Road and the project driveway intersection and concluded
the southbound shared left-right lane should be split into separate, exclusive left and
right turn lanes. The Department of Public Works has included this mitigation measure
as a recommended Condition of Approval, With the implementation of this mitigation
measure, the significant traffic related impact will be reduced to a less-than-significant
level.
Noise
Development Title Table 9-1025.9 Part I lists Religious Assembly as a noise sensitive
land use. A portion of the project site lies within the 65 dBL noise contour for North
State Route 99 East Frontage Road. The 65 dB contour line along North State Route 99
East Frontage Road is located 779 feet from the side of the road pursuant to General
Plan Table Ill.D-4A. Classroom building one is 400 feet away from the front property
line and approximately 570 feet away from the road, which falls within the 65dB contour
line. A noise study was conducted by J. C. Brennan &Associates, Inc. dated June 17,
2008 and concluded standard commercial construction practices consistent with the
uniform building code will mitigate for interior traffic noise levels. The study also
concluded a sound wall six feet in height should be constructed on the western edge of
the children's play area if the children's play area is used at night. The applicant has
stated the children's play area is only used during the daytime and therefore, no
mitigation is required.
2 1
