I <br /> "This complex would induce growth." <br /> RESPONSE, TO APPEAL STATEMENT NO I <br /> The subject property is surrounded to the north, east, west, and south by property zoned AG-40. <br /> The regional religious assembly use may be conditionally permitted in the AG-40 zone with an <br /> approved Use Permit application. The church will not set a significant land use precedent in the <br /> area and will not generate a need for additional housing. Therefore, this project is not agrowth- <br /> inducing action. <br /> APPEAL STATEMENT NO 2 <br /> "It conflicts with the existing use of the land north of Fright Mile Road." <br /> RESPONSE TO APPEAL STA'I'EMEN`I' NO. 2 <br /> The existing use of land north of f ight Mile Road is currently agricultural and Bear Creek abuts <br /> the western and northern property lines of the project site. The Religious Assembly-.Regional use <br /> type may be conditionally permitted in the agricultural zone with an approved Use Permit <br /> application. A noise study dated June 17, 2008 by J. C. Brennan & Associates, Inc. and a traffic <br /> study dated May 8, 2008 by Dowling Associates, Inc. were performed. Hours of operation for the <br /> church will be from 9:00 a.m. to 3:00 p.m. Mondays, Tuesdays, Thursdays, and Fridays and from <br /> 9:00 a.m. to 1 :00 p.m. on Sundays. The two proposed classrooms will operate on Sundays only <br /> from 9:00 a.m. to 1:00 p-m. The noise study concluded standard commercial construction <br /> practices consistent with the uniform building code will mitigate for interior traffic noise levels. <br /> The study also concluded there is a potentially significant impact to the children's play area and <br /> if the play arca is used at.night a sound wall six feet in height should be constructed on the <br /> western edge of the children's play arca. The applicant has stated the children's play area will <br /> not be used at night and therefore, no mitigation is required. As a Condition of Approval, the <br /> applicant will be required to construct the masonry wall if the play area is used at night. The <br /> traffic study identified a potentially significant impact.regarding on-site circulation with the <br /> intersection of Fight Mile Road and the project's proposed private driveway. The study <br /> concluded the southbound shared left-right on-site lane of the driveway should be split into <br /> separate, exclusive left and right turn lanes to ensure any impacts from traffic will be less-than- <br /> significant. This mitigation measure was included as a Condition of Approval. Additionally,a <br /> six foot fence i5 proposed along the perimeter of the property. Wherefore, the project will not <br /> conflict with existing land uses as traffic and noise issues have been addressed and the use will <br /> be contained on-site. <br /> APPEAL STA"ITMI;N'I'NO. 3 <br /> "It would have a significant effect on the environment in the long run." <br />
