b <br /> -3- <br /> RESPONSE TO APPEAL STATEMENT NO. 3 <br /> The Initial Study identified potentially significant effects regarding the project's impact to noise <br /> and traffic. No other potentially significant impacts were identified in the Initial Study. A noise <br /> study and traffic study were performed. The noise study concluded standard commercial <br /> construction practices consistent with the uniform building code will mitigate for interior traffic <br /> noise levels. The study also concluded a sound wall six feet in height should be constructed on <br /> the western edge of the children's play area if the children's play area is used at night. The <br /> traffic study concluded the southbound shared left-right on-site lane at the project's private <br /> driveway fronting Eight Mile Road should be split into separate, exclusive left and right turn <br /> lanes. These mitigation measures were included as Conditions of Approval. These Conditions of <br /> Approval will ensure the project will have a less than significant effect on the environment in the <br /> long run. <br /> APPEAL STATEMENT NO. 4 <br /> "The taking of this farmland adds to the continual loss of farmland and the adverse effect on <br /> surrounding agricultural use." <br /> RESPONSE TO APPEAL STATEMENT NO. 4 <br /> The 17-acre primary project site (APN4 059-260-58)is identified as Farmland of Local Importance <br /> on the Important Farmland 2002 Map and is not considered prime farmland. The associated roads <br /> are located on prime farmland and will result in a loss of 6.70 acres of prime farmland. There <br /> are nine agricultural parcels to the south,ranging in size from 1.69 acres to 9.56 acres and all <br /> parcels are zoned agricultural with scattered residences. The parcel to the east has orchards, and <br /> Beau Creek and the levee abut the subject property to the north and west. <br /> APPEAL STATEMENT NO. 5 <br /> "Issues concerning water, septic, parking, lighting, traffic, air quality, and aesthetics were not <br /> properly considered." <br /> RESPONSE TO APPEAL STATEMENT NO. 5 <br /> The septic system and water well will be constructed under permit and inspection of the <br /> Environmental Health Department. At full buildout,the applicant will be required to provide 330 <br /> parking spaces. The applicant is proposing to provide a total of 466 parking spaces which meets <br /> the minimum parking requirements. As a Condition of Approval, any lighting shall be designed to <br /> confine direct rays to the premises. To mitigate for traffic impacts, a traffic study was performed <br /> and as a Condition of Approval,the southbound shared left-right on-site lane of the driveway <br /> f shall be split into separate, exclusive left and right turn lanes.
