Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Use Permit No. PA-0600287 with the Findings and Conditions of Approval contained in
the staff report.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any
applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
• This finding can be made because the Religious Assembly- Regional use type may be
conditionally permitted in the AG-40 (General Agriculture, 40 acre minimum) zone with an
approved Use Permit application. The project site has a General Plan designation of
General Agriculture (A/G). The AG-40 zone is an implementing zone of the of the General
Agriculture designation of the General Plan. The project is consistent with the goals,
policies, standards, and maps of the General Plan. There are no Master Plan, Specific Plan,
or Special Purpose Plans applicable to this site.
2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
• This finding can be made because additional utility and sanitation systems are not required.
The project will be required to be served by an on-site well, septic system, and on-site
retention basin. The applicant has conducted a Soil Suitability/ Nitrate Loading study and
the sewage system will be constructed under permit and inspection by the Environmental
Health Department. The Environmental Health Department is also requiring that the
applicant conduct a percolation test to determine that the area is suitable for septic tank
usage. Additionally, as a Condition of Approval, the applicant will obtain access from State
Route 99 East Frontage Road and will obtain secondary access via frontage from Eight Mile
Road,
3. The site is physically suitable for the type of development and for the intensity of development.
• This finding can be made because the 17.08 acre primary parcel involved is of adequate
size and shape to accommodate the proposed use and all yards, building coverage,
setbacks and other requirements of the Development Title. The Site Plan shows that there
is sufficient area for parking and circulation, in compliance with Standards of the
Development Title. The access driveway will be wide enough for a two-way access.
San Joaquin County PA-0600287/Harvest Bible Church
Community Development Page 6
