sent to the San Joaquin Co. :il of Governments (SJCOG) for reviev,_ SJCOG determines that <br /> the applicant can participate in the San Joaquin Multi-Species Habitat Conservation and Open <br /> Space Plan (SJMSCP) and the applicant chooses to participate, then the proposed project is <br /> consistent with the SJMSCP, as amended, as reflected in the conditions of project approval for <br /> this proposal. Pursuant to the Final EIR/EIS for San Joaquin County Multi-Species Habitat <br /> Conservation and Open Space Plan (SJMSCP) dated November 15, 2000, and certified by <br /> SJCOG on December 7, 2000, implementation of the SJMSCP is expected to reduce the impacts <br /> to biological resources resulting from the proposed project to a level less than-significant. If the <br /> applicant chooses not to participate, then the applicant will be required to participate in a similar <br /> mechanism that provides the same level of mitigation. <br /> Bear Creek abuts the western and northern property lines of the project site. Development Title <br /> Section 9-1510.5 states that parallel to any natural bank of a waterway, a natural open space for <br /> riparian habitat and waterway protection shall be maintained to provide nesting and foraging <br /> habitat and the protection of waterway quality. The minimum width of said open space shall be <br /> one-hundred (100) feet, measured from the mean high water level of the natural bank or fifty (50) <br /> feet back from the existing riparian habitat, whichever is greater. Water-dependent uses may be <br /> permitted in this buffer. Additionally, there is an existing levee which protects the existing riparian <br /> habitat. As a Condition of Approval, the Department of Public Works is requiring a building <br /> setback of ten feet from the toe of the levee. The nearest proposed building (18,000 square foot <br /> multi-purpose building) to Bear Creek is located 1,000 feet away, which lies outside of the <br /> riparian habitat buffer. The buffer will ensure that the proposed project will have a less than <br /> significant impact on the existing riparian habitat. <br /> 5. Noise <br /> 5 a. Development Title Table 9-1025.9 Part I lists Religious Assembly as a noise sensitive land <br /> use. A portion of the project site lies within the 65 dBL noise contour for North State Route 99 <br /> East f=rontage Road. The 65 dB contour line along North State Route 99 East Frontage Road is <br /> located 779 feet from the side of the road pursuant to General Plan Table IIID-4A. Classroom <br /> building one (Building 5) is 400 feet away from the front property line and approximately 570 feet <br /> away from the road, which falls within the 65dB contour line. A noise study was conducted by J. <br /> C. Brennan & Associates, Inc. dated June 17, 2008 and concluded standard commercial <br /> construction practices consistent with the uniform building code will mitigate for interior traffic <br /> noise levels. The study also concluded there is a potentially significant impact to the children's <br /> play area if the play area is used at night and as a result, a sound wall six fleet in height should be <br /> constructed on the western edge of the children's play area. However, because the children's <br /> play area is only used during the daytime, no mitigation is required. <br /> 8. Utilities and Public Service <br /> 8.a. The underlying project will not be required to be served by public services. Water will be <br /> provided by an on-site well. Sewer services will be through a septic system. Storm water <br /> drainage will be retained on-site and will be reviewed and permitted by the Building Department <br /> and the Department of Public Works. <br /> 9, Transportation/ Circulation <br /> 9. a. The project site is located near the northeast corner of Eight Mile Road and North State <br /> Route 99 East Frontage Road. A traffic study dated May 8, 2008 was conducted by Dowling <br /> Associates, Inc.. The study determined the highest level of traffic generated by the Church will be <br /> on Sundays between 10:00 a.m. and 11:00 a.m. The traffic study identified a potentially <br /> significant impact to the intersection of Eight Mile Road and the project driveway intersection and <br /> Initial Study - 8 - Rev 5-00 <br />
