FINDINGS FOR VARIANCE <br /> Finding No. 1: Special Circumstances <br /> Because of special circumstances applicable to the property, including size, <br /> shape, topography, location, or surroundings, the strict application of the <br /> regulation deprives the property of privileges enjoyed by other property in the <br /> vicinity and under identical zoning classification. <br /> The following is a summary of the applicant's statements: On February 9, 2010. <br /> ...Chevron began construction after receiving a permit and a variance to build a 260 <br /> square foot on premise sign, more than four times the size of the permitted use for this <br /> zone on the property just north of the Rogers Media project. This sign is 40 feet high <br /> and completely blocks the outdoor advertising sign rendering its use worthless...we <br /> have had our property rendered worthless by the act of a neighbor and the County by <br /> granting a sign size four times the legal code. <br /> • This finding can be made because the location of the existing pole sign for the <br /> gas station prevents motorists traveling southbound on State Route 99 and State <br /> Route 99 West Frontage Road from having a clear view of the existing billboard <br /> sign. Although there are no other existing billboard signs within a mile radius to <br /> the north or south of the existing billboard sign, other billboard signs under the <br /> same zoning classification are in locations with unobstructed views. <br /> Finding Two: No Special Privileges <br /> The granting of the Variance will not constitute a grant of special privileges <br /> inconsistent with the limitations upon other properties in the vicinity and zone in <br /> which the property is situated. <br /> Applicant's Statement: "Precedent has been made to grant a variance to Chevron at <br /> 14800 South Highway 99 so the on premise sign could be viewed. Precedent has been <br /> made by granting a variance at 12565 West Klo Road that the off premise sign could not <br /> be viewed due to blockage from an on premise sign on the same property. This <br /> variance would not constitute a special privilege at all and in fact if not granted would <br /> deny to us privileges that have already been afforded to neighbors and direct <br /> competitors in the immediate area." <br /> • This finding can be made because all of the other existing billboard signs along <br /> State Route 99 have clear views from the freeway. The Site Approval to <br /> increase the sign face area was approved and upon construction, partially <br /> obstructed the view of the existing billboard sign. The request to increase the <br /> height of the existing billboard sign by fifteen feet is the minimum height required <br /> to make the billboard sign visible to travelers. Approval of this Variance will not <br /> constitute a grant of special privileges. <br />
