The proposed zone district is consistent with the General Plan, any applicable Master Plan, <br /> and any applicable Specific Plan;and <br /> b. The proposed zone district is reasonable and beneficial at the time(Development Title <br /> Section 9-812.4). <br /> The Board of Supervisors previously determined that conditionally approving ZR-96-3 was consistent with <br /> the General Plan. They also determined that with the conditional zoning, the Zone Reclassification was <br /> reasonable and beneficial at the time. If Condition 1 is removed from the I-US.10 zoning, the second <br /> basis for Zone Reclassification cannot be made because the Environmental Health Department"feels <br /> strongly that providing monitored wastewater treatment(public), public water,and drainage is appropriate <br /> to protect public health and future environmental problems." Creating public health and future <br /> environmental problems is not considered reasonable or beneficial to the area. <br /> Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Deny Zone Reclassification No.PA-02-442 based on the inability to make the required"Bases <br /> for Zone Reclassification." <br /> Bases for Zone Reclassification <br /> 1. The proposed zone districts are consistent with the General Plan. <br /> • This determination can be made because the proposed I-L zone Is the implementing zone for <br /> the Limited Industrial General Plan designation. <br /> 2. The proposed zone district is reasonable and beneficial at this time. <br /> This determination cannot be made because creating public health and future environmental <br /> problems due to the lack of public services is not considered reasonable or beneficial to the <br /> area. Recently the Central Valle Re ional Water Quality Control Board issued a violation of <br /> wastewater discharge to the Arbor Mobile Home Park located on the east side of State <br /> Route 99 The mobile home park has endured severe flooding and drainage problems in <br /> the past twenty-five (25)years which has resulted in the evacuation of people by boat and <br /> Al-wheel drive vehicles The Environmental Health Department has indicated that similar <br /> public health and environmental problems could occur on the proposed project site if <br /> zoning condition 1. is eliminated. <br /> San Joaquin County PA-02-442\Calkins <br /> Community Development Page 4 <br />
