Conditions <br /> Site Approval Application No. SA-99-29 was approved by the Community Development <br /> Department on . The effective date of approval is . This approval will expire on , <br /> which is 18 months from the effective date of approval, unless (1) all Conditions of Approval have <br /> been complied with, (2) all necessary building permits have been issued and remain in force, and <br /> (3) all necessary permits from other agencies have been issued and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be <br /> fulfilled prior to the establishment of the use and the issuance of any building permits. Those <br /> Conditions followed by a Section Number have been identified as ordinance requirements <br /> pertinent to this application. Ordinance requirements cannot be modified, and other ordinance <br /> requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Jeff Fisher, 468-9653) <br /> a. BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING PERMIT." The Site <br /> Plan required as a part of the building permit must be prepared by a registered civil engineer or <br /> licensed architect. This Plan must show drainage, driveway access details (including gates), on- <br /> site parking, landscaping, signs, existing and proposed utility services, and grading (refer to the <br /> "SITE PLAN CHECK LIST for details). A fee is required for the Site Plan review. (Development <br /> Title Section 9-884) <br /> b. APPROVED USE: This approval is for a 72-foot-high monopole cellular communications tower <br /> and a 10-toot by 20-foot equipment shelter as shown on the Site Plan submitted March 31, 1999. <br /> c. SETBACKS: The proposed tower and accompanying equipment shall be set back a minimum of <br /> twenty (20) feet from the front property line. (Development Title Table 9-410.3) <br /> d. MAINTENENCE OF FACILITIES: All freestanding structures, antennas, and supporting <br /> equipment associated with wireless telecommunication shall be maintained in good condition by <br /> the provider of the telecommunication facility and, whenever necessary, repaired or replaced. <br /> (Development Title Section 9-1065.7) <br /> e. REMOVAL OF FACILITIES: Freestanding structures, antennas, and supporting equipment <br /> associated with wireless telecommunication shall be removed by the provider of such facilities and <br /> the site restored to its pre-construction state if said facilities have not been operational or used for <br /> a period of six (6) consecutive months. Removal and site restoration shall be completed within <br /> ninety (90) days of the end of said six (6) month period. To guarantee removal of unused or <br /> abandoned facilities, the Review Authority may require the applicant to post a bond or other <br /> suitable security instrument.
