for the Aero-Turbine Project may, from time to time, be amended <br /> or modified in the following manner : <br /> ( 1 ) Administrative Amendments . Upon the written request of <br /> DEVELOPER for a minor amendment or modification of the <br /> Development Plan, Parcel Map or Conditions of Approval <br /> including, but not limited to, (a ) the location of <br /> buildings, streets and roadways and other physical faci- <br /> lities, or (b) the configuration of development areas, <br /> the Planning Director shall determine whether the <br /> requested amendment or modification is consistent with <br /> this Agreement, the General Plan and applicable provi- <br /> sions of the County zoning ordinance in effect as of the <br /> Effective Date. For purposes of this Agreement, the <br /> determination whether such amendment or modification is <br /> minor shall refer to whether the amendment or modifica- <br /> tion is minor in the context of the overall Project. If <br /> the Planning Director finds that the proposed amendment <br /> is both minor and consistent with this Agreement, the <br /> General Plan, and the applicable provisions of the <br /> COUNTY zoning ordinance the Planning Director may <br /> approve the proposed amendment without notice and public <br /> hearing. Amendments or modifications approved pursuant <br /> to this Subsection (1 ) shall not constitute subsequent <br /> discretionary approvals subject to further CEQA review. <br /> ( 2) Non-Administrative Amendments .
