ATTACHMENT "A" <br /> Introduction <br /> 1.1 Purpose of this Environmental Impact Report <br /> San Joaquin County,as the Lead Agency,has prepared this Draft Environmental Impact Report(DEIR)to <br /> provide the public and responsible and trustee agencies with information about the potential environmental <br /> effects of the proposed Munn&Perkins Quarry Project(generally referred to in this DEIR as the"Proposed <br /> Project'). <br /> This DEIR was prepared in compliance with the California Environmental Quality Act(CEQA),and the <br /> CEQA Guidelines(California Code of Regulations,Title 14). As described in CEQA Guidelines Section <br /> 15121(a),an EIR is a public informational document that assesses the potential environmental impacts of a <br /> proposed project and identifies mitigation measures and alternatives to the Proposed Project that could minimize <br /> or avoid significant adverse environmental impacts.CEQA requires that state and local government agencies <br /> consider the environmental consequences of projects over which they have discretionary authority.The EIR is <br /> an informational document used in the planning and decision-making process.It is not the purpose or intent of an <br /> EIR to recommend either approval or denial of a project. <br /> CEQA requires that a lead agency neither approve nor cant'out a project as proposed if there are feasible <br /> alternatives or mitigation measures that would avoid or substantially lessen the significant environmental effects <br /> of the project(CEQA Guidelines Sections 15021, 15091, and 15092). If the mitigation measures or project <br /> alternatives are determined to be infeasible,the lead agency must make findings describing the economic, <br /> legal, social,technological,or other reasons. CEQA also requires that decision-makers balance the benefits of a <br /> proposed project against its unavoidable environmental risks. If environmental impacts are identified as <br /> significant and unavoidable,the project may still be approved if it is demonstrated that social,economic,or other <br /> benefits outweigh the unavoidable impacts.The lead agency would then be required to state in writing the specific <br /> reasons for approving the project based on information presented in the EK as well as other information in <br /> the record. This process is defined as a"Statement of Overriding Considerations"by CEQA Guidelines <br /> Section 15093. <br /> 1.2 Project Overview <br /> The applicant, George Reed LLC,has submitted a Revisions of Approved Actions Application to amend San <br /> Joaquin County Ordinance Requirement No.4 of a previously approved Quarry Excavation Permit(QX-89-0002). <br /> San Joaquin County Ordinance Requirement No.4 states: "The hours of operation with the exception of <br /> periods of declared National, State, or County emergency,daily operations will be restricted to the period <br /> between 5:00 a.m. and 9:00 p.m." <br /> The Revisions of Approved Actions request is to extend the hours of operation from 9:00 p.m.to 5:00 a.m.for <br /> projects that contain specifications that limit work to nighttime hours.The number of extended nights will not <br /> exceed 125 nights per year provided there are no unexpected delays in construction work.Nighttime work will <br /> be limited to the asphalt batch plant,loaders,trucks including a water truck,and scale house.Excavation activities <br /> and the crushing of rock will not be permitted during the expanded nighttime hours of 9:00 p.m.to 5:00 a.m.The <br /> Revisions of Approved Actions request will not remove any of the existing other previously approved <br /> conditions of approval including the Reclamation Plan. <br /> San Joaquin County QX-89-0002/Aggregates Inc. <br /> Community Development Page 13 <br />
