An Initial Study/Mitigated Negative Declaration(IS/MND)was originally prepared for the Proposed Project; <br /> however the applicant voluntarily pulled the MND from consideration when numerous comments were <br /> received from neighboring properties expressing concern over the potential for noise from night time operations, <br /> odor from the asphalt batch plant,and dust generation from existing operations.Due to the issues raised after release <br /> of the MND,it was determined that an Environmental Impact Report(EIR)should be prepared for the proposed <br /> Munn&Perkins Quarry Project. <br /> 1.3 Type of Environmental Impact Report <br /> The CEQA Guidelines identify several types of EIRs, each applicable to different project circumstances. <br /> This EIR is prepared as a project-level EIR pursuant to CEQA Guidelines Section 15161. This type of EIR <br /> focuses primarily on the changes in the environment that would occur as a result of project development, <br /> and examines all phases of a particular project(i.e.,planning,construction,operation). Therefore, this EIR <br /> focuses on the direct and reasonably foreseeable indirect changes in the environment resulting from a change <br /> in operational hours. <br /> IA Use of this Environmental Impact Report <br /> The FIR will be used by San Joaquin County as a tool to evaluate the Proposed Project's environmental impacts.The <br /> EIR will be reviewed and considered by the decision making body, in this instance the County Planning <br /> Commission,in its decision to approve or deny the Proposed Project. <br /> A Responsible Agency complies with CEQA by considering the EIR or Negative Declaration prepared by the <br /> Lead Agency and by reaching its own conclusions on whether and how to approve the project involved. <br /> 1.5 CEQA Environmental Impact Report Process <br /> 1.5.1 Notice of Preparation <br /> In accordance with CEQA Guidelines Section 15082,the County circulated a Notice of Preparation(NOP)for <br /> this EIR on January 26,2011,for a 30-day public review period that concluded on February 27,2011.The <br /> NOP was circulated to the public,interested parties,and local,state,and federal agencies. Its purpose was to <br /> inform the interested parties that the Proposed Project could have significant effects on the environment and <br /> to solicit their comments. The NOP is included as Appendix A of the EIR. <br /> One comment letter from Caltrans was received during the NOP comment period(see Appendix B). Caltrans <br /> requested an analysis to determine the effects of the project on state highway facilities. <br /> 1.5.2 Scope of the EIR <br /> Per Public Resources Code Section 21002.1,to provide more meaningful public disclosure,reduce the time and <br /> cost required to prepare an environmental impact report,and focus on potentially significant effects on the <br /> environment of a proposed project, lead agencies shall,in accordance with Section 21100, focus the discussion <br /> in the environmental impact report on those potential effects on the environment of a proposed project which <br /> the lead agency has determined are or may be significant. <br /> Based on early consultation,the initial study fust prepared for the project,the NOP,and comments received on <br /> both the NOP and the proposed IS/MND,the lead agency has determined that the EIR will focus on the <br /> following environmental effects: <br /> San Joaquin County QX-89-0002/Aggregates Inc. <br /> Community Development Page 14 <br />
