Requirement No.4 states: "The hours of operation with the exception of periods of declared <br /> National, State,or County emergency, daily operations will be restricted to the period between <br /> 5:00 am. and 9:00 p.m." <br /> The Revisions of Approved Actions request is to extend the hours of operation from 9:00 p.m. to <br /> 5:00 a.m. for projects that contain specifications that limit work to nighttime hours. The number <br /> of extended nights will not exceed 125 nights.Nighttime work will be limited to the asphalt <br /> batch plant, loaders,trucks including a water truck, and scale house. Excavation activities and <br /> the crushing of rock will not be permitted during the expanded nighttime hours of 9:00 p.m. to <br /> 5:00 a.m. The Revisions of Approved Actions request will not remove any of the existing other <br /> previously approved conditions of approval including the Reclamation Plan. <br /> C. ENVIRONMENTAL REVIEW& PUBLIC PARTICIPATION <br /> The County conducted an extensive environmental review for this project that included the <br /> scoping period,the Draft EIR, public review of the Draft EIR, and the Final EIR. The Final EIR <br /> consists of the Draft EIR, as revised plus the Final EIR. The Final EIR includes all written <br /> comments received regarding the Draft EIR,responses to comments, and the Mitigation <br /> Monitoring and Reporting Program(MMRP). <br /> The implementation of the EIR scoping and review process is described in Section 1.5 of the <br /> Final EIR. The following is a summary of the County's environmental review for this project. <br /> • A Notice of Preparation(NOP)was distributed to the State Clearinghouse,responsible <br /> agencies, interested groups and individuals, and surrounding property for a 30-day <br /> comment period between January 26, 2011 and February 27, 2011. The environmental <br /> issues raised during the scoping process were considered in the Draft EIR; <br /> • The Draft EIR for the Munn &Perkins Quarry Excavation Permit was submitted to the <br /> State Clearinghouse (SCH#2005082001)on May 9, 2011. A second public notice was <br /> issued on July 11,2011. The public review and comment period for the Draft EIR concluded <br /> on August 22,2011; <br /> • The Final EIR was distributed for more than 10 days prior to the November 17, 2011 <br /> Planning Commission hearing. <br /> C.1. Certification EIR <br /> Pursuant to CEQA Guidelines Section 15090(Title 14 of the California Code of Regulations, <br /> Section 15090)the Commission certifies that the Final EIR has been completed in compliance <br /> with the California Environmental Quality Act("CEQA") and the State CEQA Guidelines. The <br /> Commission certifies the Final EIR for the actions described in these findings and in the Final <br /> EIR, for the Project as described above. <br /> 2 <br />
