PC: 10-15-92 <br /> MS-92-133 <br /> Agricultural Viability; <br /> An owner-operator homesite parcel is not intended to be an agriculturally viable parcel <br /> but rather is intended to permit the financing or refinancing of a residence for the owner <br /> of the property. Parcel 2 contains 10 acres because the subject parcel is under <br /> Williamson Act Contract, and the smallest parcel permitted under Contract is 10 acres <br /> (see Section 9-2351 f a} of the Planning Trtle). The 30-acre parcel is simply the result of <br /> subdividing a 10-acre parcel from a 40-acre parcel, and similar requests have been <br /> consistently approved by staff under the provisions of the Planning Title's area exceptions <br /> for homesite parcels. <br /> Land Use Compatibility: <br /> In analyzing the project's potential land use conflicts, staff considered the impacts <br /> associated with the three additional residences that may result from the approval of this <br /> subdivision. Impacts on traffic, air quality, and service requirements were found to be <br /> only incremental, given the relatively small amount of development (three houses and <br /> accessory structures) that may take place on a parcel containing 126 acres. <br /> HAZARDS/CONSTRAINTS: <br /> Flooding: <br /> The subject parcel is located in the 100-Year Flood zone and can be expected to be covered by <br /> approximately seven feet of water during such a flood. All new construction and substantial <br /> improvements to existing structures on the site shall be consistent with the provisions of Section <br /> 9-10325 of the Planning Title's Flood Prevention Ordinance. The finished elevation of the lowest <br /> floor must be at least one foot above the 100-Year Flood elevation. <br /> ENVIRONMENTAL CONSIDERATIONS: <br /> The Initial Study that was prepared for this project on July 1, 1992, indicated that no significant, adverse <br /> environmental impacts would result from this project. On the basis of that review, a Negative Declaration <br /> was prepared. In addition, a Certificate of Fee Exemption with a 'De Minimis Impact Finding' has been <br /> prepared which states that the project will not have an adverse effect on wildlife resources. <br /> -10- <br />
