Legal Review of PEIR Documents <br /> The Sohagi Law Group (SLG)will provide a legal review of the <br /> Administrative Draft EIR and Administrative Final EIR within their available <br /> budget and will focus on comprehensiveness and compliance with the <br /> requirements of the CEQA,including all recent updates and amendments, as <br /> well as ongoing developments in case law. SLG has recently been assisting <br /> in the CEQA process for a very similar facility associated with the Port of <br /> Los Angeles and another project for the Intermodal Container Transfer <br /> Facility(ICTF)Joint Powers Agency. and is very familiar with the diesel <br /> emission, health risk, and other issues related to such facilities. <br /> k t C. Technical Approaches to EIR <br /> Based on our review of the NOP and the comment letters,we have prepared a <br /> scope of work that addresses all critical CEQA topics.At this time,our scope <br /> does not include the topics of mineral resources,population/housing,and <br /> recreation,based on the NOP and our understanding of these topics not being <br /> of relevance to the project and project site.We plan to review all final NOP <br /> comment letters that may include some letters submitted after our preparation <br /> of this proposal,to determine if the scope of work may need to be adjusted. <br /> r <br /> Land Use and Planning <br /> 1 <br /> Issues <br /> The proposed development would occur on lands that are designated General <br /> Agriculture(AIG)in the County's General Plan and zoned as General <br /> r Agriculture—40 acre minimum.The project site is located between the cities <br /> of Manteca and Lathrop in a narrow band of unincorporated County land. It <br /> is our understanding that the site is within the Sphere of Influence of the City <br /> of Manteca,but not that of the City of Lathrop.This type of multimodal <br /> facility is permitted as a conditional use in the County's agricultural land use <br /> designation. The main land use and planning issue of concern are expected to <br /> be land use compatibility given that the operations will occur 24/7. <br /> Comments on the NOP have raised issues such as air and noise impacts from <br /> site operations, especially for nearby residents of the Del Webb community <br /> in Manteca.
