A signage plan shall be submitted with the improvement <br /> plan and shall comply with the signage plan approved with <br /> the Use Permit. <br /> (1) The area of a sign shall not exceed ten percent of <br /> the area of the wall against which it is located. <br /> (2) Lighting of signs shall be limited to internal <br /> illumination, nonf lashing, and nonanimated. No <br /> signs shall be illuminated on any lot adjoining or <br /> directly across the street from residential <br /> . property. <br /> (3) Small directional signs and other signs necessary <br /> to the functioning of the business shall be <br /> permitted. <br /> k. A lot line adjustment, merger or subdivision is required <br /> to eliminate property lines which traverse the project. <br /> 1. If requested by individual homeowners located in close <br /> proximity to Patterson Pass Road or the portion of Hansen <br /> Road ' south of Schulte Road (i.e. those residences <br /> depicted -in Figure 3 , "Existing Land Uses, " in the <br /> Gateway General Plan Amendment FEIR) , Bay Cities agrees <br /> to meet with the homeowners to discuss the funding and <br /> implementation of noise attenuation devices, to be <br /> limited to installation of double-pane, acoustically <br /> rated (STC) windows and mechanical ventilation to provide <br /> closed window, interior circulation, or noise walls. <br /> Any such homeowner request for implementation of noise <br /> attenuation devices shall be funded by Bay Cities if it <br /> is made within three years after a Certificate of <br /> Occupancy has been issued for the Bay Cities project and <br /> if observed noise levels are measured at 65 db Ldn or <br /> greater at the homeowner' s property line. If a noise <br /> study prepared by Safeway or Bay Cities indicates that <br /> current noise levels at any of the affected homeowner's <br /> property lines along Patterson Pass Road are already <br /> measured at 65 db Ldn or above, mitigated down to a level <br /> of 45 db inside the house, then a 3 db increase in <br /> current noise levels measured at the property line within <br /> three years of Certificate of Occupancy shall require Bay <br /> Cities to install noise attenuation devices, if so <br /> requested by the homewowner(s) . <br />
