County Community Development. and Public <br /> Works staff shall prepare a staff report analyzing the <br /> effectiveness of the TSM plan during the previous 12- <br /> month period and recommend any appropriate changes to the <br /> plan to reach the goals stated above. <br /> The review process shall include notification to the <br /> surrounding property owners and other interested parties. <br /> if significant issues or controversies are raised during <br /> the annual review, the Community Development Director <br /> may; at his discretion, refer the annual review process <br /> or specific issues to the Planning Commission for review <br /> .or <br /> action. <br /> Based upon discussion and testimony during the staff <br /> review and upon staff and any Planning Commission <br /> recommendations, Bay Cities shall revise the TSM plan <br /> appropriately. The annual TSM plan shall be resubmitted <br /> to the County, subject to the approval of the Directors <br /> of Public Works and Community Development within one <br /> month of the annual review. <br /> W. If it' is determined during the annual review and <br /> recertification of the TSM plan that the number of actual <br /> observed auto or truck trips exceed the limits projected <br /> in the Final Supplemental Environmental Impact Report, <br /> Bay Cities shall be required to revise the TSM program <br /> originally adopted by the County to reduce daily or peak <br /> hour trips to the allowed level. Efforts to reduce peak <br /> hour trips may include, but are not limited to, the <br /> adoption of programs by Bay Cities to subsidize transit <br /> passes for employees, give financial rewards to employees <br /> who use carpools or vanpools, or provide shuttle service <br /> for employees. <br /> Annual Monitoring Program <br /> X. Bay Cities shall be required to participate in an annual <br /> monitoring program, pursuant to the legal requirements of <br /> AB 3180 (Annual Mitigation Monitoring) . Included in the <br /> annual monitoring program shall be the review and <br /> recertification of the Transportation Systems Management <br /> Plan, described already above, as well as a review of the <br /> monitoring programs set forth in the Bay Cities Use <br /> Permit UP 88-19 Mitigation Monitoring Program, attached <br /> to these Conditions of Approval. <br /> Bay Cities shall be required to pay the full cost of the <br />
