Conditions of Approval <br /> UP 88-19 <br /> Page -7- <br /> Mitigation Monitoring Program for the project. At the <br /> discretion of the Community Development Director, Bay <br /> Cities may be required to submit funds annually in <br /> advance to the county in order that County incurred costs <br /> to implement the Mitigation Monitoring Program the coming <br /> year may be credited against the funds. If required by <br /> the Director, these mitigation monitoring funds shall be <br /> placed in an interest-bearing account. <br /> Y_ The annual Mitigation Monitoring Program will monitor the <br /> success of the TSM plan, as well the progress made in <br /> continuing to mitigate impacts related to the project' s <br /> auto and truck traffic; to endangered species habitat; to <br /> the ongoing operation of the wastewater treatment plant, <br /> ponds, and land disposal area; and the other mitigation <br /> measures outlined in the attached Mitigation Monitoring <br /> Program. <br /> Specific additional Conditions of Approval included in <br /> the annual Mitigation Monitoring Program are further <br /> described in the Public Works, Caltrans, and Department <br /> of Fish and Game sections below. <br /> West Tracy Area/Specific Plan(s) <br /> Z. Bay Cities shall agree to participate in their fair share <br /> of the cost to prepare a West Tracy Area Plan and/or <br /> Specific Plan(s) , if and when such a planning process is <br /> initiated by San Joaquin County and/or the City of Tracy <br /> within: two years of the date of Use Permit approval. Bay <br /> Cities shall pay the cost of preparing these plans <br /> according to a fair share allocation based on acreage or <br /> development potential of lands included in the planning <br /> study area. <br /> aa. The developer shall participate in an area of benefit, <br /> Mello-Roos, or any other assessment-type district <br /> established for the purpose of funding infrastructure <br /> improvements and planning, if such a financial mechanism <br /> is established by the County or the City of Tracy as <br /> implementation of a West Tracy Area/Specific Plan or any <br /> other comprehensive planning program in the greater West <br /> Tracy area. <br /> The establishment of any such district shall include a <br /> provision to credit Bay Cities or other developers, for <br /> transportation improvements which were previously <br /> constructed as condition of project approval (s) , and <br />
