The developer shall participate in an area of benefit, <br /> Mello-Roos, or any other assessment-type district <br /> established for the purpose of funding infrastructure <br /> improvements and planning, if such a financial mechanism <br /> is established by the County or the City of Tracy as <br /> implementation of a West Tracy Area/Specific Plan or any <br /> other comprehensive planning program in the greater West <br /> Tracy area. The developer reserves the right of protest <br /> ,under applicable law, including protest of the allocation <br /> of benefit and the spread of assessments. <br /> ordinance Requirements: <br /> The Ordinance Requirements listed below have been identified <br /> as pertinent to this project. Other Ordinance Requirements <br /> may also apply. Ordinance Requirements are not appealable. <br /> ac. All parking spaces, driveways, and maneuvering areas must <br /> be paved and permanently maintained with asphalt or <br /> cement. Bumper guards must be provided where necessary <br /> to protect adjacent structures or properties. <br /> ad. All parking stalls and driveway directions must be <br /> delineated. <br /> ae. Parking lot lighting shall meet the following minimum <br /> standards: <br /> (1) The equivalent of one foot candle illumination <br /> shall be provided throughout the parking area. <br /> (2) All lighting shall be on a time clock or <br /> photosensor system. <br /> (3) All lighting shall be designed to confine direct <br /> rays to the premises, with no spillover beyond the <br /> property line. <br /> af. The number of parking spaces shown on the site plan is <br /> adequate for the proposed use. The parking spaces shall <br /> be shown on the Improvement Plan. <br /> ag. All repair work shall be conducted inside a building. <br /> ah. Any new utility lines shall be placed underground. <br />
