The frontage improvements for Patterson Pass Road shall <br /> be constructed in conformance with the standards for a <br /> 124-foot right-of-way major collector road. <br /> k. (1) Truck entrance should be located near the east side <br /> of the project. <br /> i (2) Special "Radius" Driveway approaches shall be <br /> utilized for all vehicles access points. Minimum <br /> of width of ingress and egress lanes shall be <br /> forty-four feet (441 ) . <br /> 1. Public Improvements and utility systems shall be <br /> completed prior to the issuance of a certificate of <br /> occupancy. <br /> M. Bay Cities, in conjunction with the developer of the <br /> Gateway Business Park and Safeway projects, shall <br /> complete construction of all frontage improvements prior <br /> to building. occupancy. All rights-of-way for required <br /> roadway improvements will be acquired at the cost of the <br /> applicant•. If Bay Cities or other developers are unable <br /> to acquire the right-of-way through their own <br /> negotiations, the County will utilize its power of <br /> eminent domain after deposit by Bay Cities and other <br /> developers of all monies necessary to accomplish the <br /> acquisition through condemnation procedures. <br /> Bay Cities and other developers shall prepare an estimate <br /> for condemnation, including all attorney fees, court <br /> fees, review fees by Public Works and other departments, <br /> and recording fees. In addition, a 10 percent <br /> contingency fee shall be added to the above noted <br /> estimates. If actual costs exceed amounts deposited, Bay <br /> Cities and other developers are to provide additional <br /> funds necessary to complete the acquisition upon request <br /> from the County. Any monies left over from the <br /> condemnation procedures shall be returned to the <br /> developers. The estimate is subject to review and <br /> approval of the Department of Public Works. <br /> o. Frontage improvements along Schulte Road and Patterson <br /> Pass Road shall be constructed to the ultimate future <br /> roadway section on Bay Cities side of the roadways, in <br />
