CONDITIONS OF APPROVAL <br /> PA-1100015 <br /> KAMPGROUNDS OF AMERICA, INC./GIGL1O <br /> Entertainment Perms Revisions of Approved Actions Application No. PA-1100015 was approved by the <br /> Community Development Department on October 31, 2014. The effective date of approval is November <br /> 10, 2014. This approval will expire on May 9, 2016, which is 18 months from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building <br /> permits have been issued and remain in force, and (3) all necessary permits from other agencies have <br /> been issued and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: jOhR Funderburg, [209] 468 3160 <br /> Stephanie Stowers, [209] 468-9653) <br /> a) IMPROVEMENT PLAN: APPLICATION-IMPROVEMENT PLAN". The Site Plan required, as a part of <br /> the improvement plan must be prepared by a registered civil engineer or licensed architect. This Plan <br /> must show drainage, driveway access details including gates, on-site parking, landscaping, signs, <br /> existing and proposed utility services, and grading (refer to the "SITE PLAN CHECK LIST" for details). <br /> A fee is required for the Site Plan review. (Development Title Section 9-884) <br /> b) APPROVED USE: This approval is for an Entertainment Permit for an existing restaurant and bar <br /> including outdoor entertainment as shown on the site plan dated januaFy 24, 2August 21 2014. <br /> c) HOURS OF OPERATION: All entertainment establishments shall be closed and all patrons shall <br /> vacate the premises between 2:00 a.m. and 6:00 a.m., except that as part of a New Year <br /> celebration, entertainment establishments may remain open until 3:00 a.m. on January 1st. <br /> (Development Title Section 9-1085.8 [a]) <br /> d) HOURS OF OPERATION (RESPONSIBLE PERSON): A Responsible Person must be present in <br /> the entertainment establishment during all hours that the entertainment establishment is open and <br /> offering entertainment. (Development Title Section 9-1085.8 [c]) <br /> e) NOISE ABATEMENT: Outdoor establishments shall comply with the requirements of section 9- <br /> 1025.9. <br /> f) ORDERLY DISPERSAL REQUIRED: Each Responsible Person shall use reasonable efforts to <br /> cause the orderly dispersal of patrons from the vicinity of the establishment at closing time. <br /> (Development Title Section 9-1085.14) <br /> g) ALCOHOLIC BEVERAGE ON PREMISES: <br /> (1) It is unlawful for any person to bring an alcoholic beverage onto the premises unless such action <br /> is allowed by the entertainment establishment's ABC license. <br /> (2) It is unlawful for any Responsible Person to allow any person to bring an alcoholic beverage onto <br /> the premises unless such action is allowed by the entertainment establishment's ABC license. <br /> (Development Title Section 9-1085.15) <br /> h) ATTIRE: In any establishment where the sale of alcoholic beverages is lawfully permitted, it is <br /> unlawful for any Responsible Person to allow any person to remain on the premises while such <br /> person is unclothed, or in such attire, costume, clothing or semi-transparent covering as to expose to <br /> PA-1100015 (ENT, RA) Conditions of Approval 1 <br />
