(Development Title Section 9-1085.16) <br /> i) DISTURBING THE PEACE—DISORDERLY CONDUCT: Each Responsible Person shall make <br /> Reasonable Efforts to prevent the admittance of any person whose conduct is described in Penal <br /> Code Section 415 (fighting, loud noise, offensive words in public places) or 647 (disorderly conduct) <br /> at the premises or on any parking lot or similar facility used by the establishment. Each Responsible <br /> Person shall make Reasonable Efforts to remove any persons exhibiting such conduct from the <br /> establishment. (Development Title Section 9-1085.9) <br /> j) INTOXICATED CUSTOMERS: Each Responsible Person shall make Reasonable Efforts to prevent <br /> the admittance of any obviously intoxicated person. For purposes of this section, a person is <br /> "obviously intoxicated" when he or she exhibits readily apparent outward manifestations of drug or <br /> alcohol intoxication, including but not limited to, inability to walk or stand in a normal manner, <br /> bloodshot or glassy eyes, flushed face, incoherent or slurred speech, alcoholic breath, belligerence <br /> or other loud or boisterous conduct, extreme agitation or nervousness or mental confusion. <br /> (Development Title Section 9-1085.10) <br /> k) DISORDERLY CONDUCT WITHIN FIFTY (50) FEET PROHIBITED: Each Responsible Person <br /> shall make Reasonable Efforts to control the conduct of patrons to prevent or minimize disorderly or <br /> unlawful conduct within the establishment and within fifty (50) feet of the establishment. <br /> (Development Title Section 9-1085.13) <br /> 1) DISPLAY OF PERMITS: The permit issued pursuant to this chapter shall at all times be displayed in <br /> a conspicuous place in the entertainment establishment for which it was issued and shall be <br /> immediately produced upon the request of any law enforcement or code enforcement <br /> officer. (Development Title Section 9-1085.22) <br /> m) BUILDING DEPARTMENT REQUIREMENTS: The following California Building Code (CBC) and <br /> San Joaquin County Ordinance requirements will be applicable and shall be incorporated in the <br /> construction plans before submittal to the Building Inspection Division: <br /> (1) A building permit application including plans will be required According to state law, the plans must <br /> be prepared by a registered engineer or licensed architect and shall be submitted for review and <br /> approval. <br /> (2) The required plans must be complete at the time of submittal for a building permit Plans must <br /> address building design and construction fire and life safety requirements accessibility and show <br /> compliance with the current California codes and San Joaquin County ordinances <br /> (3) The deck proposed for use as an assembly area will require a structural code analysis report and <br /> necessary plans prepared by an architect or engineer in accordance with the CBC The report shall <br /> address the support of the deck and any necessary alterations to provide a minimum uniform load <br /> live load of 100 psf. <br /> (4) Based on a configuration using tables and chairs the deck will have an occupant load factor of 15 <br /> with a total occupant load of approximately 80 people. This may increase if tables and chairs will <br /> not be part of the proposed use and must be specified on the plans. <br /> (5) Currently the deck has one point of access and egress. An additional exit path will be required <br /> (6) The path of travel from the deck to the public way must be accessible to persons with disability in <br /> compliance with Chapter 11 B of the CBC. <br /> (7) The architect or engineer shall also review all guardrails for compliance with the design criteria in <br /> Section 1607.8.1 of the CBC. <br /> PA-1100015 (ENT, RA) Conditions of Approval 2 <br />
