UP-98-9 OF <br /> FRANK AND HELEN ALEGRE (CIO MIKE HAKEEM) <br /> (FOURTH SUPERVISORIAL DISTRICT) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors: <br /> 1. Approve the Negative Declaration;and <br /> 2. Approve the Time Extension for Use Permit No. UP-98-9 for a period of six months to <br /> April 21, 2000 with the previously adopted Findings (Attachment "Al and subject to the <br /> previously approved Conditions of Approval(Attachment"B). <br /> BACKGROUND: <br /> Although the applicants have an approved Use Permit (UP-92-22) for a truck terminal for 75 trucks, the <br /> applicants established heavy equipment repair (FTG Equipment Repair) on the site without benefd of the <br /> required permit. The following uses, which the applicant intends to continue, have already been established <br /> pursuant to approved Use Permit No. UP-92-22: truck terminal, storage of construction materials on the south <br /> side of the project area in concrete block storage bins (telephone sales only, no retail), and office support for <br /> the construction service and trucking uses. <br /> On March 23, 1999 the Board of Supervisors approved Text Amendment No. TA-98-10 and Use Permit No. <br /> UP-98-9. Text Amendment No.TA-98-10 made the following changes to the Development Title: <br /> Create separate use types for"Heavy Equipment, Sales"and Heavy Equipment, Repair." <br /> Permit"Construction Services" and"Heavy Equipment, Repair"with an approved Site Approval in the <br /> I-T zone as part of a legally established truck terminal, provided the said use does not exceed thirty- <br /> three and one-third (331/3) percent of the area devoted to the originally approved I-T use. <br /> Use Permit No. UP-98-9 was approved to establish Heavy Equipment Repair at the existing truck terminal and <br /> to add wholesaling of construction materials. The text amendment was necessary because the uses proposed <br /> (construction services and heavy equipment repair)were not permitted in the I-T zone. <br /> BOS LETTER PAGE 9 <br />
