Mr. Dalton informed the applicant that the Montezuma Fire District requires a fire hydrant, and <br /> indicated on the plan where the best area would be. <br /> Mr. Neely reviewed the Department of Public Works requirements. Mr. Neely asked <br /> Mr. Nunez if he would like to pay a fee for the Department of Public Works to put a Board <br /> packet together for him and have the County Surveyor take the final map to the Board to be <br /> accepted. <br /> Mr. Nunez indicated yes. <br /> 10:30 a.m. 3. USE PERMIT APPLICATION NO. UP-99-25 REVISIONS OF <br /> JF APPROVED ACTIONS OF LARRY & CARLENE METTLER (C/O <br /> ARBOR VINEYARDS, INC.) A Revision of Approved Actions of Use <br /> Permit application for a small winery (500 case). Revisions to include <br /> (1) The addition of Marketing events. (2) The use of portable toilets at the <br /> events. (3) No installation of.a new well. (4) A one-year Time Extension. <br /> Project will utilize existing shed and grapes are grown on site. Located <br /> on the west side of Alpine Road, 1200 feet north of Kettleman Lane, east <br /> of Lodi (APN: 049-210-05; 15451 N. Alpine Road, Lodi). <br /> Jeff Fisher, Associate Planner; Charlene & Larry Mettler, Arbor Vineyards were present for this <br /> item. <br /> Mr. Fisher introduced the project. <br /> Mrs. Mettler indicated that there is one correction. Mrs. Mettler indicated that they are not <br /> asking for a Boutique Winery status, and that they are a small Winery and want to stay small <br /> Winery. Mr. Martin informed the applicants that the Community Development Department is not <br /> changing the status of the winery, and that the winery is still Food Manufacturing under the old <br /> ordinance. Mr. Martin indicated that they were looking at the size of the winery in terms of <br /> volume and applying the current ordinance, Marketing Events, as though it were a Boutique <br /> Winery, but not changing the status of the project. <br /> Ms. Mettler indicated that they would do the perk test but asked if there was another study that <br /> could be made instead of such a costly one as the soil suitability study/nitrate loading. Ms. <br /> Mettler informed staff that their winery would not go over five hundred (500) cases and asked <br /> why such a big test is required. Mr. Godinho informed the Mettler's that he respected what they <br /> are saying and he explained the need for the testing. Ms. Mettler informed Mr. Godinho that <br /> there is very little wastewater used, and asked why couldn't they use water disposal above <br /> ground unless they become large and then need to do the testing. Mr. Godinho indicated that <br /> the letter from the Environmental Health Division that requires the testing was dated January 27, <br /> 2000, and that the updated letter dated October 1, 2001 reads that the conditions of approval, <br /> dated January 27, 2000, still apply, so his supervisor who put the letter together still wants the <br /> testing done. Mr. Mettler indicated that they are calculating only 1500 gallons of wastewater in <br /> a year. Mr. Godinho agreed that it was very little. Ms. Mettler informed staff that she had <br /> contacted Fran Focus of White Slough and asked if they did an above ground water disposal <br /> system if they could handle that amount per year. Ms. Mettler put about 3 barrels of pumice <br /> back into the vineyard. <br />
