Air Quality <br /> A referral was sent tasthe San Joaquin Valley Air Pollution Control District(SJVAPCD)regarding the project. <br /> SJVAPCD responded;to the referral and stated that the applicant would be required to adhere to several <br /> District rules including those covering emissions reductions during construction, a dust control plan and <br /> regulation of open burning on the property. If the project is approved and found to create a public nuisance, it <br /> could be in violation and subject to District enforcement action. SJVAPCD requested the applicant have a <br /> Health Risk Assessment(HRA)conducted to determine the project's air quality impacts..A HRA was <br /> conducted by the SJVAPCD in accordance with the Office of Environmental Health Hazard Assessment <br /> Health Assessment Guidelines in March of 2007. The baseline hazard index as identified by the Health <br /> Assessment Guidelines, indicates that a significant health risk occurs when a hazard index is greater than <br /> 10 in one million cancer cases or greater than or equal to one for either the acute or chronic hazard index. <br /> The study determined the maximum offsite risks from the facility operations were 2.49 in'one million, 0.055 <br /> for the chronic hazard index, and 0.32 for the acute hazard index. Based on the results from the HRA, the <br /> studyconcluded that.the proposed egg production project is not expected to pose a significant cancer risk <br /> or acute/chronic hazard. In addition the applicant would be required to adhere to several District rules <br /> including those covering emissions reductions during construction, a dust control plan and regulation of <br /> open burning on the property. The applicant is proposing to dispose of birds that die by means of <br /> incineration on the project site. The incineration process is subject to District review and permit approval <br /> prior to its use. The applicant shall be required to submit all documentation to the District for review and <br /> permitting. If the project is approved and found to create a public nuisance, it could be in violation and <br /> subject to District enforcement action. <br /> Biological Impacts:? <br /> The project site is subject to the provisions of the San Joaquin County Multi-Species Habitat Conservation and <br /> Open Space Plan (SJMSCP). The applicant has indicated that he is willing to participate in the SJMSCP. <br /> Should the applicant choose against participating in the SJMSCP, the applicant will be required to provide <br /> alternative mitigation.Fn an amount and kind equal to that provided in the SJMSCP. <br /> Drainage <br /> The project applicant'shall be required to meet the storm water drainage requirements as outlined in <br /> Development Title Section 9-1135, which states that storm water drainage shall be retained on-site. The <br /> drainage pattern and corresponding storm drain improvements shall be shown on the Site Plan and drainage <br /> calculations shall be prepared by a registered civil engineer or architect and shall be included on the site plan. <br /> Land Use Conflicts,' <br /> The project site is Iodated on property with a General Plan designation of AIG (General Agriculture) and a <br /> zoning designation of AG-80 (General Agriculture, 80 acre minimum). The project site and the surrounding <br /> areas have historically been used for agricultural purposes and consist of farms of varying sizes with scattered <br /> residences. The Cityof Lathrop has annexed land to the south of the proposed project. Old River acts as a <br /> natural barrier between the project site and the Lathrop.city limits_ The proposed project is not located within <br /> the Sphere of Influence for the City of Lathrop. <br /> On June 22, 2004 the:San Joaquin County Board of Supervisors approved revisions to the San Joaquin <br /> County Right-to Farm,:Ordinance Section 6-9004(e)of the County Code which states that the County of San <br /> Joaquin recognizes and supports the right to farm agricultural lands in a manner consistent with accepted <br /> customs, practices, aPd standards. Residents of property on or near agricultural land should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, including but not <br /> limited to noise, odors, insects, fumes, dust, the operation of machinery of any kind during any kind during any <br /> twenty-four(24) hour period (including aircraft), the application by spraying or otherwise of chemical fertilizers, <br /> San Joaquin County ` PA-05007291O1ivera <br /> Community Development Page 5 <br />
