The Fish and Wildlife Service is requiring compensation. (It is <br /> noted that the F&WS requires compensation for the grading already completed; there is an <br /> additional issue regarding the planned storage pond). <br /> 15. The storage pond design is reportedly completed and has been approved by the Division of Dam <br /> Safety. A Technical Advisory Committee hearing is planned for 14 November 2001 to address the <br /> issue. <br /> 16. Ben Hall stated the land application areas have been disced as required by the Winter Contingency <br /> Plan. However, observation of the land application areas indicated less than half of the area had <br /> been disced, and in the upper application area almost none of the area had been disced. <br /> 17. Ben Hall stated that the 95 acre land application area was planted with sorghum and a portion of <br /> 10 acres was planted with perennial grass, sudan grass was planted on 15 acres in the southeast <br /> corner, oats had been planted on the lower parcel. (It was noted upon viewing the land application <br /> areas that the sorghum, perennial grass,nor the oats were observable). A crop reported to be sudan <br /> grass was observed in two of the checks. Each of the checks was flooded with strongly discolored <br /> and odiferous water. <br /> 1 S. Recommendations to improve cropping presented in the Discharger's technical reports required by <br /> the C&A Order(i.e. adding organic material to soil or addition of fertilizer to improve crop <br /> growth)were not implemented and according to Ben Hall, fertilizer will be added to irrigation <br /> water in the future but there is no schedule to implement the recommendations. None of the <br /> recommended boron plant tissue tests have been performed. Staff are concerned that the addition <br /> of fertilizer to the process wastewater will result in fertilizer being discharged to the creek. <br /> 19. Ben Hall stated that to control off-site flow of wastewater, two bermed areas were constructed in <br /> natural drainage areas downstream of the tank farm. Portable diesel powered pumps pumped <br /> tailwater that accumulated behind the berms.to the checks. Ben Hall is considering constructing a <br /> permanent pumping station at the downstream berm area. California Department of Fish and <br /> Game(DFG) contacted the Regional Board and informed staff that the berms are illegal as is the <br /> transportation of wastewater in natural drainage courses. <br /> 20. Too much wastewater was added to the checks resulting in standing wastewater and odiferous <br /> conditions. The Regional Board received odor complaints on 22 October 2001 and 19 November <br /> 2001. <br /> i 21. The one million gallon storage pond has been routinely overflowing for the past 18 months. <br /> Although this is an on-going problem, the Discharger apparently has no plans to correct the <br /> situation. Field inspection of the pond indicated the Discharger has installed an overflow pipe <br /> ifrom the'pond to the natural drainage nearby. Although required to do so by the WDRs, the <br /> Discharger has failed to report the overflows. <br /> 22. Three influent pipes were observed at the one million gallon storage pond. Ben Hall was unable to <br /> identify the source of the wastewater being discharged. Two of the three pipes were observed <br /> discharging wastewater. Considerable floating matter and a strong odor was noted at the pond. <br /> i <br /> 23. At the above ground storage tanks containing olives, a practice known as "recirculating the tank" <br /> was observed. The practice stirs the acetic acid in the storage tanks resulting in foaming of <br /> wastewater out the top of the tank.
