Use Permit <br /> Application No. UP-78-9 was approved, and the use was legally established. Subsequent changes in the <br /> property's zoning and the list of permitted uses in the agricultural zones have had the result of making <br /> the business a nonconforming use. Because the use is a nonconforming use, it could continue to operate <br /> at its current location subject to receiving approval for Site Approval Application No. SA-95-6 and meeting <br /> the adopted Conditions of Approval. <br /> The Development Title's administrative procedures do not permit the review authority to deny an <br /> application and require compliance with conditions of approval prior to granting the approval. <br /> Delta Protection Commission <br /> The Delta Protection Commission has indicated that additional written Findings must be made in order <br /> for the project to be in compliance with the State's Delta Protection Act of 1992.
