El Dorado St., Stockton, CA <br />Dear Mr. Von Flue: <br />This responds to the Inspection Report dated 6/26/07 and the Amended Report dated <br />6/29/07, for the referenced site. <br />Item # 4 a & b and 7 — tank and secondary containment assessment not on site. The <br />company was not aware that this was required. This belief is based partly on the fact that <br />the tanks were installed, with secondary containment, in the late 1980s and early 1990s <br />(ref. Hazardous Waste Tank System Requirements for Large Quantity Generators and <br />Onsite Treatment Facilities, Section E 5 provides an exemption from the requirement for <br />tank and containment assessment for existing tank systems). In addition, the DTSC <br />Regulations for Onsite Hazardous Waste Treatment Notification, states that tank and/or <br />containment system certifications are required for PBR facilities only, not CA <br />(conditionally authorized) facilities. <br />As a result of your inspection and report, the company has contracted with <br />Environeering, Inc. to prepare a tank and containment system certification signed by a <br />registered professional engineer. This assessment will be repeated every five years as <br />stated in the Notice of Violation included in your report. <br />Item 8 — a revised plot plan showing the new food grade wash rack is enclosed. <br />Item 10 — Waste Minimization Certificate — the company is not subject to SB 14 <br />requirements since source reduction would require curtailing/stopping the business <br />activity of washing truck trailers. The enclosed response was forwarded to the DTSC in <br />2004 (copy on site). DTSC has not requested a certification since. <br />
