We have no objection to reporting <br /> semi-annually to the Planning Department the n�zrrber of tons <br /> sold, however, we have no tray to keep records o: excavated <br /> cubic yards on a daily basis . We would agree to stay within <br /> certain areas of the excavation during certain_ time periods <br /> and this is covered by the excavation maps . The yardage <br /> figures are estimates . The application is to excavate materials <br /> in a defined limited area which has an estimated amount of <br /> material that would be removed . The actual yardage removed could <br /> be somewhat higher or lower, depending on what should be left <br /> to achieve the desired rehabilitation result . An exact numerical <br /> maximum on the yardage could therefore work to the detriment of <br /> the desired result as well as to that of the applicant . <br /> Regarding proposed Condition No . 12, paving of the <br /> interior roads used by haul trucks is not necessary. We would <br /> agree to oil the roads used by' our customers from Waverly <br /> Road to our office site which will suffice to achieve the <br /> desired goal, dust control . All other interior roads are temporary <br /> and constantly changing location so it would be impractical to <br /> oil them. They will be sprinkled for dust control . <br /> The additional condition that was made a :part of the revised <br /> proposed condition No . 12, that is, that haul trucks shall be <br /> sprinkled prior to their departure is impractical . It is also <br /> impossible . My client cannot sprinkle haul loads prior to <br /> departure as to do so would throw the material out of specification. <br /> Our specifications require that the material contain 4% moisture <br /> to meetspecs and this means the material is damp and not dusty <br /> when it is loaded into the trucks . The Departmentof Motor Vehicles <br /> has laws governing the hauling of material which will create <br /> dust on the public highways and anyone so doing is subject to <br /> fine . <br /> We will maintain a water truck on the site and will <br /> sprinkle the roads when necessary, hotirever, daily sprinklings <br /> should not be necessary during the winter months . Prevailing <br /> winds in that area are out of the northwest and blow to the <br /> southeast and this will help mitigate the dust problem. <br /> Condition No . 13 is O .K. <br /> Condition No. 14 is G .K. except that we request that we <br /> be able to have a reasonable length of time after excavation <br /> to submit our reseeding plan. <br /> Condition 15 is O .K. <br />
