y
San Joaquin Counts- Board of Zoning Adjustment Page Five
Regarding prcz-osed Condi cion No . 2 . This would be a
very inflationary item in the cost of ourf doing business .
If the .County wan;,s to make quarterly inspections at their
own expense they are welcome to do so.
Regarding proposed Condition No . 24 we want the permit
to include operations directly connected with the aggregate
industry. We need those functions to be competitive and
efficient . My client has no intentions of erecting a cement
batch plant but can foresee the erection of an asphalt batch
plant .
Regarding Condition No. 25 an alternative excavation
plan has been submitted therefore this condition probably
will not be necessary under the new excavation plan.
Regarding Condition No . 26, Licensing of the Stockton
Sand and Gravel Scale is as a private weighmaster, not as a
public weighmaster. Under state and county regulations a certified
weight certificate can only be given for the product line .
Therefore, we are already limited to giving weights for our
own materials . Obviously this condition is superfluous
and should be deleted.
Regarding Condition N0. 27 . The sight entry should be left
in the hands of the Public Works Department who in fact will be
involved in the assurance of an encorachment permit for commercilal
use. The proposed condition puts the entry site on property
that is not leased by Stockton Sand and Gravel nor is it owned
by it . See also our comment regarding Condition No . 22 .
Regarding Cc::dition No . 28 . This has already been accomplished .
Sincerely yours,
MAYALL, HURLEY, KNUTSEN, SMITH & GREEN
By
MARK- STEPHEN ADAMS
Attorneys for Applicant , Stockton
Sand and Gravel, Inc .
cc all members of the Board of
Zoning Adjustment
cc San Joaquin County Planning Department
cc Christopher Paas , Brewer, Patridge & Morris
J
