-9- <br /> 3 ) Increased Truck Traffic. Although Mr. Merian contends <br /> that relocating his operation from Shelton to Waverly Road <br /> will not increase truck traffic on Shelton Road, he is <br /> clearly in error. Besides the increases due to the addition <br /> of a cement batching operation , trucks which now use the <br /> Shelley Road access to the Calaveras plant site (all the <br /> trucks which haul eastward, a significant portion of <br /> Stockton Sand and Gravel business) would be forced to travel <br /> on Shelton all the way back to Escalon-Bellota Road to <br /> gain access to Highway 26 . <br /> As a condition to avoid the road safety hazards listed in <br /> numbers 2 and 3 above, the applicant should be required <br /> to provide material for the paving of Waverly Road to the <br /> south of the landfill facility and Flood Road from Waverly <br /> Road to Escalon-Bellota Road . Trucks should be required <br /> to use that route. This would give the heavy truck traffic <br /> a much safer route, avoiding the "Y" intersection and the <br /> blind curves along Shelton Road . (An additional benefit <br /> to the County of this plan would be a more-direct route <br /> through sparsely populated areas for transport of garbage <br /> from Lovelace Station. ) <br /> 4) Gravel and Asphalt Spills. Loaded trucks frequently <br /> spill portions of their loads on County roads leaving the <br /> current excavation site . These spills would be particularly <br /> likely and dangerous at the "Y" intersection described in <br /> number 2 above. Although some of these trucks may not be <br /> legally overloaded by weight, they are frequently loaded <br /> so that material spills over easily. <br /> Stockton Sand and Gravel siould be required to load the <br /> trucks with no more material than can be hauled without <br /> spills . The County should hold the applicant responsible <br /> for spills on County roads , for the damage and hazard <br /> they cause. The County should require that the applicant <br /> post a performance bond adequate to cover road damage and <br /> liability associated with the safety hazards created by <br /> the spills. <br /> E. Operating Hours Consistent with Residential Uses <br /> Since the site of the proposed excavation is within 135 <br /> feet of an existing residence, the hours of the proposed operation <br /> would have to be consistent with residential uses. Mr. Merian ' s <br /> existing operation produces noise which is clearly audible more than <br /> one mile from the project; as noted above, he has double-shifted the <br /> plant, operating very late into the night and very early in the <br /> morning. <br />
